The city of Petoskey, Mich. has enacted a property registration requirement within 60 days of vacancy.  The program will require an initial annual registration accompanied by a fee of $150.00, as well as subsequent semi-annual registrations after the first 365 days accompanied by a $300.00 renewal fee and a $300.00 reinspection fee.Property Registration Ordinance

AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY CODE (BUILDING AND BUILDING REGULATIONS) TO REGULATE VACANT BUILDINGS

ARTICLE II - VACANT BUILDINGS

Sec. 7.7. Registration of Vacant Buildings

a. Requirement: Owners of buildings vacant for more than 60 consecutive days shall register the property with the City's Code Enforcement Officer within 14 days after the 60-day period or the effective date of this article, whichever is later.

c. Annual Renewal: Registration is valid for the first 365 days (from the date of registration) and must be subsequently renewed every 6 months (from the date of registration) until the building is occupied and a certificate of compliance is issued.

Sec. 7-9. Fees

a. Registration Fee: A registration fee is an amount set from time to time by City Council resolution must be paid upon registration and renewal.

b. Inspection Fee: Owners shall pay an inspection fee, set by City Council resolution, for initial and annual safety and maintenance inspections.

Thornton Village, IL

The village of Thornton, Ill. has enacted a property registration requirement within 10 days of foreclosure filing or 10 days of vacancy. The program will require semi-annual registration accompanied by a fee of $350.00.

FORECLOSURE AND VACANT PROPERTY ORDINANCE

Sec. <ORD. CHAP>.<ORD. SEC> INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE

(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Registrable Property with the Village Registry, and, at the time of registration, indicate whether the Registrable Property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Registrable Property subject to the mortgage under a Foreclosure Action.  A separate registration is required for each Real Property subject to a Foreclosure Action, regardless of whether it is occupied or vacant.

Sec. 7-12-5(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $350.00 for each Registrable Property.  Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of $350.00 are due within ten (10) days of the expiration of the previous registration.  Said fees should be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted Real Properties, (33) post-closing counseling and Foreclosure intervention limited to Owner-occupied persons in Default, which may not include cash and mortgage modification assistance, and (4) for any related purposes as may be adopted in the policy set forth in this Chapter.  Said fees shall be deposited to a special account in the Village's Department dedicated to the cost of implementation and enforcement of this Ordinance and fulfilling the purpose and intent of this Chapter.  None of the funds provided for in this Section shall be utilized for the legal defense of Foreclosure Actions.

Sec. <ORD. CHAP>.<ORD. SEC> INSPECTION AND REGISTRATION OF REAL PROPERTY THAT IS NOT SUBJECT TO A MORTGAGE IN FORECLOSURE

(a) Any Owner of Vacant Registrable Property, as defined in this Chapter, located within the Village shall within ten (10) days after the Registrable Property becomes Vacant, register the Vacant Registrable Property with the Village Registry.  Structures that are Vacant Registrable Property at the time of adoption of this Ordinance must register within fifteen (15) days of the date this Ordinance takes effect.

Auburn, NY

The city of Auburn, N.Y. has amended its property registration requirement to reflect the following escalating fee schedule:

Initial Registration: $300.00
1st Renewal: $600.00
2nd Renewal: $1,200.00
3rd Renewal: $1,800.00
4th and Subsequent Renewals: $2,500.00

The program will continue to require registration within 30 days of vacancy.

Chapter 183. Vacant Building Registry

Sec. 183-4.  Vacant building registration.

A.  The owner of a vacant building will register with the Code Enforcement or Fire Chief's office no later than 30 days after any building becomes a "vacant building," as defined above, or not later than 30 days after being notified by a code enforcement officer of the requirement to register.  A code enforcement officer or Fire Department officer may identify vacant buildings through his/her routine inspection process as well as through notification by residents, neighborhood associations and other community groups that a building may be eligible for inclusion on the registry.  Notice will be served upon, or sent by mail to, the owner, and any registered property manager, and to the property address.  Notice will be deemed received by the owner, property manager, or an occupant, as the case may be, upon personal delivery or three days in Cayuga County or five days for other locations after service by first-class mail.  The City may also post notices on the City's website to provide additional notice to the public. However, the City's failure to post such violations on the City's website will not constitute a defense to any enforcement proceeding or collection of fines.

I.  Vacant building registration fees.

(1)  The owner of a vacant building will pay a registration fee as determined annually by the fee schedule adopted by City Council or by separate resolution of the City Council at any time during the course of a fiscal year.  The registration fee is due and payable upon registration; to wit: no later than 30 days after any building becomes a "vacant building," as defined above, or no later than 30 days after being notified by an enforcement officer of the requirement to register.

(2)  If the building is to remain vacant, then the owner will also pay an annual vacant building fee.  The amount of said fee shall be determined annually pursuant to the fee schedule adopted by the Auburn City Council or by separate resolution of the City Council. Said fee schedule shall provide for differing amounts dependent upon the number of years that the building is vacant.

Palmdale, CA

The city of Palmdale, Calif. has amended its property registration requirement to reflect an annual fee of $366.50. The program will continue to require annual registration for vacant properties within 10 days of foreclosure filing.

Chapter 8.38

VACANT AND ABANDONED PROPERTY REGISTRATION

8.38.030 Registration.

Any beneficiary/trustee, who holds a deed of trust on a property located within the City of Palmdale, shall perform an inspection of the property that is the security for the deed of trust, upon default by the trustor, prior to recording a notice of default with the Los Angeles County Recorder's Office.  If the property is found to be vacant or shows evidence of vacancy, it is, by this chapter, deemed abandoned and the beneficiary/trustee shall, within 10 days of the inspection, register the property with the Planning Director on forms provided by the City.

(A)  If the property is occupied but remains in default it shall be inspected by the beneficiary/trustee, or an agent/designee of the beneficiary/trustee, monthly until (1) the trustor or another party remedies the default; or (2) the foreclosure is completed and ownership is transferred to a new owner who is not the former beneficiary or trustee; or (3) it is found to be vacant and shows evidence of vacancy at which time it is deemed abandoned, and the beneficiary/trustee shall, within 10 days of that inspection, register the property with the Planning Director on forms provided by the City.

(D)  The annual registration fee established by City Council resolution, shall accompany the registration form.  The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required. Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31st of the calendar year due.
