East Moline, IL

The city of East Moline, Ill. has enacted a property registration requirement within 30 days of vacancy or foreclosure.  The program will require semi-annual registration accompanied by a fee of $150.00 for residential properties and $200.00 for commercial properties.Property Registration Ordinance

4-2-7: VFPO GUIDELINES:

     (A)  Application: Applicant to submit application to the community development department if the property is vacant more than (30) days.  Vacant registration includes commercial and residential buildings/structures, vacant commercial and residential lots, and parcels with no building/structure.  A separate application shall be required for each building/structure, lot or parcel identified with a separate address or separate property identification number (PIN).

     (B)  Application Fee: Applicants shall pay to the City of East Moline a registration fee of one hundred fifty dollars ($150) per residential lot every six (6) months.  Applicants shall pay to the City of East Moline a registration fee of two hundred dollars ($200) per commercial lot every six (6) months.

4-2-8: REGISTRATION AND APPEALS PROCESS:

     (A)  The City of East Moline vacant and foreclosed property registration shall be valid for a period of six (6) months.  Property owners and/or creditors are required to register any building, lot or parcel of land that is vacant for more than thirty (30) days, at any given time.  Each building/structure, lot or parcel of land with a separate address or property identification number (PIN) shall be required to register separately.  In addition to registration, property owners shall submit a plan of action regarding regular maintenance plan, future construction, and detailed timeline for completion during the vacancy.

     (B)  Creditors filing a complaint of foreclosure or executing a deed in lieu of foreclosure on any building, lot or parcel of land shall be required to register within (30) days.  The creditor shall notify the City of East Moline of any change of ownership, action plan, maintenance plan schedule, and any other changes affecting the property.

Elmwood Park Village, IL

The village of Elmwood Park, Ill. has enacted a property registration requirement within 10 days of foreclosure filing.  The program will require semi-annual registration accompanied by a fee of $300.00.

41E-5: INSPECTION AND REGISTRATION OF PROPERTY THAT IS THE SUBJECT OF A MORTGAGE FORECLOSURE SALE:

     (c)  Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Registrable Property with the Village Registry for Property Subject to Foreclosure or Foreclosure Action, and, at the time of registration, indicate whether the Registrable Property is vacant, and if so shall designate in writing a Property Manager to inspect, maintain and secure the Registrable Property subject to the mortgage under a Foreclosure Action.  A separate registration is required for each Real Property subject to a Foreclosure Action, regardless of whether it is occupied or vacant.  Mortgagees who have existing Registrable Property on the effective date of this Ordinance have 30 calendar days from the effective date to register as indicated in this Section.  A separate registration is required for each Real Property, whether it is vacant or occupied.

     (e)  At the time of initial registration, each registrant shall be required to pay a non-refundable semi-annual registration fee of three hundred dollars ($300.00).  Subsequent non-refundable semi-annual registration fees in the amount of three hundred dollars ($300.00) shall be due within ten (10) days of the expiration of the previous registration period.  Said fees are intended to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted Real Properties foreclosed properties, and (3) any other related purposes, as determined by the corporate authorities.

Elmwood Park Village, IL

The village of Elmwood Park, Ill. has amended its property registration ordinance to reflect an annual fee of $300.00 for vacant properties not subject to a foreclosure filing.  Registration will continue to be required within 15 days of vacancy.

 
 

Property Registration Ordinance 

41E-6: INSPECTION AND REGISTRATION OF VACANT BUILDINGS THAT ARE NOT THE SUBJECT OF A MORTGAGE FORECLOSURE SALE:

Owners of vacant buildings that are not the subject of a mortgage foreclosure sale shall be required to register the vacant building in the Village Vacant Building registry.  Any owner of a building who knows, or from all the facts and circumstances should know, that his or her building is or has become a "vacant building" within the meaning of this Chapter, or the owner of a building, which the Director determines at any time to be a "vacant building", or any owner of a building who's appeal from the Director's determination that a building is vacant has been denied by the Village Manager, shall take the actions provided for in this section within fifteen (15) days of (i) the date of Director's notice of determination or (ii) occurrence of the facts which would cause a reasonable person to believe that the building is a "vacant building", or (iii) denial of the appeal by the Village Manager, whichever is applicable.

     1.     Registration of Building: Any person subject to the provisions of this Section 41E-6 shall register the registrable vacant building in the Village Vacant Building Registry, on a form provided by the Village, and shall pay a three hundred dollar ($300.00) non-refundable annual registration fee.  Said annual registration fee is intended to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to vacant properties, and (3) any other related purposes determined by the corporate authorities.

Palm Bay, FL

The city of Palm Bay, Fla. has amended its property registration ordinance to reflect a registration requirement upon the filing of a Notice of Default.  The program will require annual registration accompanied by a $300.00 fee.

 
 

Property Registration Ordinance 

Sec. 99.03 REGISTRATION OF ABANDONED FORECLOSING RESIDENTIAL PROPERTIES; DUTY TO PROVIDE WRITTEN NOTICE OF ABANDONED RESIDENTIAL PROPERTY.

   (A)  All owners must register abandoned foreclosing residential properties with the Police Department, Code Compliance Division, on forms provided by the City Manager.  All registrations must state the individual owner's or agent's phone number and mailing address located within the state.  The mailing address may not be a post office box.  This registration must also certify that the property was inspected.  The owner and/or registrant must designate and retain a local individual or local property management company responsible for the security and maintenance of the property.  This designation must state the individual or company's name, phone number, and local mailing address.  The mailing address may not be a post office box.  If the property is the process of foreclosure, then the registration must be received within seven (7) days of the initiation of the foreclosure process as defined in Sec. 99.02 herein.

   (B)  A registration fee, as established by resolution of the City Council, must accompany the registration form.  All property registrations are valid for one (1) calendar year.  An annual registration fee, as established by resolution of the City Council, must accompany the registration form.  Subsequent annual registrations and fees are due within thirty (30) days of the expiration of the previous registration and must certify whether the foreclosing and/or foreclosed property remains vacant or not.

Foreclosure Registration

On September 16, 2010 the City of Palm Bay enacted Ordinance No. 2001-44 amending the code of ordinances regulating the maintenance of abandoned foreclosed residential properties within the city limits of Palm Bay, Florida.

The Ordinance requires a MORTGAGEE to register any residential property of which THE MORTGAGEE has initiated the foreclosure process upon and which is abandoned with the Police Department's Code Compliance Division.  THE MORTGAGEE should consult ordinance for the definitions of "abandoned" and "initiation of foreclosure process" for further clarification.

This registration requires a annual fee of $300 and requires A MORTGAGEE to provide the following information:

  • Owner or Agents phone number and mailing address within the State (If a PO Box is mailing address, must be accompanied by a physical address)
  • Certify that the property has been inspected
  • Designate and retain a local individual or local property management company responsible for the security and maintenance of the property.  "Local" is defined as within twenty (20) driving miles of the property.  This designation must state the individual or company name, phone number, and local address (PO Box is not acceptable).
An annual registration fee, as established by resolution of the City Council, must accompany the registration form.  Subsequent annual registrations and fees are due within thirty (30) days of the expiration of the previous registration and must certify whether the foreclosure and/or foreclosed property remains vacant or not.
