Durand, MI

The city of Durand, Mich. has enacted a property registration requirement within 15 days of foreclosure filing or vacancy.  The program will require annual registration accompanied by a fee of $100.00.

Foreclosed, Vacant and Abandoned Property Registration

AN ORDINANCE TO ESTABLISH A REGISTRY OF FORECLOSED, VACANT, AND ABANDONED PROPERTY WITHIN THE CITY OF DURAND; REQUIREMENTS; FEES

Sec, 14-477. Property registration required.

(a)  An owner of a foreclosed, vacant, or abandoned property within the City shall register the structure with the Building Department within 15 days of the earlier of:

(1)  The property becoming subject to foreclosure;

(2)  The property becoming a vacant property;

(3)  The property becoming an abandoned property; or

(4)  Notice being sent to the owner of the structure by the Building Department that the structure has been declared a foreclosed, vacant, or abandoned property.

Sec. 14-486.  Fess and charges.  All fees applicable to this article shall be set from time to time by resolution of the City Council and shall include at a minimum:

(1)  The registration fee charged to the owner at the time of registration of the foreclosed, vacant, or abandoned property; 

(3)  A bi-annual monitoring fee charged to the owner for periodic inspections by the Building Department to assure continuing compliance with this article.  A nonrefundable payment of the first year of monitoring fees shall be prepaid by the owner at the time of registration;

Brighton, MI

The city of Brighton, Mich. has enacted a property registration requirement upon first time vacancy.  The program will require an initial fee of $115.00 followed by a monthly administration charge of $135.00 due by the first of each month.

ARTICLE VII

ABANDONED AND VACANT BUILDINGS

Sec. 18-105.  Registration.

Owners of abandoned buildings shall register such properties with the city and pay a monthly administration fee as set forth in the fee schedule. The duty to register an abandoned structure shall not require prior notice to the owner by the city. Registration of an abandoned structure does not preclude the city from taking appropriate actions to secure the property or to issue orders to repair or abate dangerous, hazardous, or unlawful conditions or from acting to eliminate an imminent hazard to public health and safety.

Sec. 18-107.  Registration and administrative fee.

An owner of an abandoned structure, whether registered or not, shall pay a registration fee and a monthly administrative fee for the time during which such structure remains abandoned.  The abandoned structure registration fee and monthly administrative fee shall be set forth in the city's fee schedule. Failure to register an abandoned structure or pay the quarterly administrative fee, shall be cause for penalties assessed and are criminal violations of this chapter.

Murrieta, CA

The city of Murrieta, Calif. has amended its property registration ordinance to reflect an annual fee of $104.10.  The program will continue to require annual registration within 10 days of vacancy.

Chapter 8.44

ABANDONED RESIDENTIAL PROPERTY REGISTRATION

8.44.050 Registration.

A.  Any beneficiary/trustee who holds a deed of trust on a property located within the City of Murrieta shall perform an inspection of the property that is the security for the deed of trust upon default by the trustor and prior to recording a notice of default with the Riverside County Recorder's Office.  If the property is found to be vacant or shows evidence of vacancy, it is, by this chapter, deemed abandoned and the beneficiary/trustee shall, within ten (10) days of the inspection register the property with the chief of police or his or her designee on forms provided by the city.

B.  If the property is occupied but remains in default, it shall be inspected by the beneficiary/trustee or his or her designee monthly until:

1.  The trustor or other party remedies the default, or

2.  It is found to be vacant or shows evidence of vacancy, at which time it is deemed abandoned and the trustee shall, within ten (10) days of that inspection, register the property with the chief of police or his or her designee on forms provided by the city.

D.  An annual registration fee shall accompany the registration form.  The fee and registration shall be valid for a period of (12) twelve consecutive months; renewal shall be due and payable on the first day of the following month from the date the registration was initially required. Subsequent registrations must be received no later than the 31st day of the registration month due.

8.44.100  Fees.

The fee for registering an abandoned residential property shall be set by resolution of the city council.

Canonsburg, PA

The borough of Canonsburg, Pa. has enacted a property registration requirement within 10 days of foreclosure or upon city notice of vacancy.  The program will require annual registration accompanied by a $100.00 fee for residential properties and a $200.00 fee for commercial properties.

 

Property Registration Ordinance 

Sec. 131.9.  Registration of vacant property.

A.  Any mortgagee who holds a mortgage on real property located within the Borough shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor.  The mortgagee shall, within 10 days of the inspection, register the property with the Borough, or its designee, on forms or as directed in another manner and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

The Borough of Canonsburg

Vacant Property Registration

In accordance with Ordinance 1357 of the Borough of Canonsburg, all vacant properties in the Borough are required to be registered annually by the owners.  This ordinance was enacted to protect the health, safety and welfare of Borough residents, to prevent blight, to protect property values, and to avoid the creation and maintenance of nuisance properties.

You are still responsible for keeping the building secured, grass cut, and property maintained free of trash and debris.  Failure to do so will result in a legal citation.  If the Borough of Canonsburg must cut, clean, or otherwise perform any type of maintenance to the property, you will be invoiced for labor and equipment.  If the invoice is not paid within thirty (30) days, the property will be liened.

V. Registration Fees

The registration fees for vacant properties in the Borough of Canonsburg are as follows:

Commercial Property:

Initial registration fee is waived.  $200 for each calendar year the property remains vacant.

Residential Property:

Initial registration fee is waived.  $100 for each calendar year the property remains vacant

 

 

Austin, MN

The city of Austin, Minn. has enacted a property registration requirement within 120 days of vacancy.  The program will require annual registration accompanied by a $240.00 fee.

 
 

Property Registration Ordinance 

AN ORDINANCE FOR THE CITY OF AUSTIN, MINNESOTA ESTABLISHING A PROGRAM FOR THE IDENTIFICATION AND REGULATION OF VACANT BUILDINGS WITHIN THE CITY THE COMMON COUNCIL OF THE CITY OF AUSTIN DOES ORDAIN:

SECTION 1.  A new Section 4.26 of City Code Chapter 4, is hereby added and shall read as follows:

Subd. 5. VACANT BUILDING REGISTRATION

(A)  Application. 

a.  The owner or responsible party shall register a vacant building with the city no later than 120 days after the building becomes vacant.  The registration shall be submitted on a form provided by the city and shall include the following information supplied by the owner:

(E)  Fees.  The owner shall pay an annual registration fee.  The registration fee will be an amount adopted by ordinance by the City Council.  The amount of the registration fee shall be reasonably related to the administrative costs for registering and processing the registration form and for the costs of the city in monitoring the vacant building site.  The fee shall be paid in full prior to the issuance of any building permits or licenses, with the exception of a demolition permit.
