Section 16-35 - VACANT, ABANDONED, AND FORECLOSED PROPERTIES, BUILDING REGULATION

Sec. 16-35.4    Registration of vacant, abandoned, and foreclosed property.

b.  Vacant, abandoned, and foreclosed property shall be registered within 30 days of the vacancy or 10 days of the inspection described in section 35.5.

Sec. 16-35.6    Registration, inspection and other fees.

All fees applicable to this article shall be set by resolution of the Village Council.  Registration and inspection fees shall be paid at the time of submitting the registration affidavit. There shall also be a fee for the filing of any additional or new owner's affidavit, with such fee being set by resolution of the village's board.  For properties that are not registered within the required time, an additional fee for the added cost of the expenses in having to determine ownership, which may include, but is not limited to, title searches, shall be assessed and immediately payable.  All unpaid fees shall be charged against the real property upon which the structure is located and shall be lien upon such property in accordance with the 2006 International Property Maintenance code, or any successor code.

Garden City, MI

The city of Garden City, Mich. has enacted a property registration requirement within 60 days of vacancy.  The program will require annual registration accompanied by a fee of $500.00 for residential properties and $1,000.00 for commercial properties.

CHAPTER 155: VACANT PROPERTIES

Sec. 155.04 - Registry of Vacant Properties.

(B)  Vacant properties to be registered annually.  Owners of real property are required to register all vacant properties within 60 days of the vacancy and to reregister the properties annually thereafter.  Structures that are vacant at the time of the enactment of this ordinance must register within 60 days.

Sec. 155.07 - Annual Registration and Inspection Fee.

(A)  Creation of fee.  An annual registration and vacant property inspection fee shall be set by the city in the city's administrative fee resolution to offset the cost of processing the form, conducting the safety and maintenance inspection and maintaining the records.

(B)  Payment of fee.  The fee established in division (A) above shall be submitted with the registry information outlined in Sec. 155.05.  In addition, in the case where the owner has failed to register, the owner shall be assessed the added cost of the city's, or its designee's, expense in having to determine ownership, which may include, but is not limited to, title search and legal expenses.

  • Residential Property: Minimum Fee is $500 for initial inspection from the Building Inspector which includes 2 inspections (if needed).  Any additional inspections will be charged at $35 per inspection.

  • Non-Residential (Commercial) Property:  Minimum fee is $1000 for initial inspections from the Building and Fire Inspector which includes 2 inspections (if needed).  Any additional inspections will be charged at $60 per inspection.

Herrin, IL

The city of Herrin, Ill. has enacted a property registration requirement within 30 days of vacancy.  The program will require semi-annual registration accompanied by a fee of $25.00.

PROPERTY MAINTENANCE CODE 29-9-2

29-9-4       OBLIGATIONS OF OWNERS OF VACANT STRUCTURES.

(A)     Within thirty (30) days of a structure becoming vacant, as defined herein, the owner of the structure shall apply for a vacant structure registration certificate and pay a fee of Twenty-Five Dollars ($25.00).  If the structure is still vacant at the time of expiration of the original vacant structure registration certificate (six (6) months as defined below), the owner shall immediately apply to renew the certificate.  At the City's sole discretion, renewal may be had upon demonstrated need for a maximum of three (3) six (6) month periods, for an aggregate maximum of twenty-four (24) months total vacancy registration.  Renewed permits shall be subject to all conditions and obligations imposed by this Article on the initial certificate, including the payment of a Twenty-Five Dollar ($25.00) fee at each renewal.  It shall be the responsibility of the registered owner to file an amended registration within ten (10) days of any changes contained in the initial application, including occupancy or transfer.  During the period of registration, the owner shall provide access to the City to conduct inspections of the structure, both interior and exterior if deemed necessary by the City, and, following reasonable notice, to determine compliance with this Article and any other relevant codes and ordinances of the City.

Rolling Meadows, IL

The city of Rolling Meadows, Ill. has enacted a property registration requirement within 15 days of foreclosure filing or 15 days of vacancy.  The program will require annual registration accompanied by a fee of $300.00 for initial registration and $600.00 for each renewal.

ARTICLE XII. - VACANT, CONDEMNED, AND FORECLOSED PROPERTY REGISTRATION

Sec. 18-452. - Definitions.

Regulated property means a building, together with the real property where the building is located, that must be registered under this chapter because the building, in part or in whole, is any of the following:

(a)  Presently ordered vacated or condemned, or found by administrative adjudication or a court of competent jurisdiction to be unfit for occupancy, pursuant to the applicable provisions of this Code.

(b)  The subject of any type of foreclosure proceeding including, without limitation, the issuance or filing of: a notice of default, notice of foreclosure, lis pendens, notice of sheriffs sale or foreclosure sale, or a deed in lieu of foreclosure or sale.

(c)  Both (i) unoccupied, as it lacks the habitual presence of human beings who have a legal right to be on the premises; and (ii) satisfies any of the following criteria:

(1)   Is unsecured, or is secured by boarding or similar means.

(2)  Has been the site of criminal activity within the previous six months.

(3)  Is unoccupied and, since it was most recently occupied, was the subject of a completed foreclosure proceeding.

(4)  Has been unoccupied for over 60 days, during which time the director has issued an order to correct public nuisance conditions, and the same have not been corrected within the allotted time pursuant to the applicable provisions of this Code.

(5)  Has been unoccupied for over 180 days.

Sec. 18-453. - Responsibility of owner.

The owner of a building who has been served written notice of the determination of direction or who knows or should reasonably know from all of the facts and circumstances that their building satisfies the definition of a regulated property, must register the building with the city as a regulated property within 15 calendar days of the written notice or when the owner knew or should have known the property was a regulated property, and must meet all other requirements set forth in this article.

Sec. 18-456. - Registration requirement and owner's obligations concerning regulated property.

Owners of a regulated property must comply with this section.  Every owner of a regulated property shall be jointly and severally liable with every other owner to meet the following obligations on an ongoing basis until such time that the building is no longer a regulated property.

(a)  Annual registration.

2.  Fee.  The registration must be accompanied by the applicable fee set forth in Appendix B to this Municipal Code.  Fees shall not be pro-rated or refunded. If a new, renewal, or amended registration is filed more than 30 calendar days after the applicable due date, the late fee set forth in Appendix B shall apply in addition to any other penalty.

3.  Expiration and renewal.  Each registration shall expire, and must be renewed, no later than January 1 of each calendar year.

Other Requirements

If the subject property remains vacant into a second calendar year, and for all subsequent years it remains vacant, the registration will need to be renewal.  Renewal fees increase to $600.

 

 

 

Gadsden, AL

The city of Gadsden, Ala. has enacted a property registration requirement within 30 days of vacancy.  The program will require annual registration accompanied the following escalating fee schedule based on the square footage of the property:

1,000 sq. ft.-2,500 sq. ft.     - $300.00
2,501 sq. ft.-5,000 sq. ft.     - $350.00
5,001 sq. ft.-7,500 sq. ft.     - $400.00
7,501 sq. ft.-10,000 sq. ft.   - $450.00

ARTICLE III. REGISTRATION OF VACANT PROPERTIES

Sec. 86-96. Registration.

(a)  Upon knowledge of a commercial or industrial building being vacant, the owner and/or creditor shall within 30 days register the property as a vacant property with the building and code enforcement department of the city.

Sec. 86-99. Administrative fees.

(a)  Any owner or creditor of a commercial or industrial building required to be registered by this article shall pay to the city a registration fee in the following amount:

1,000 sq. ft.—2,500 sq. ft.

(b)  The registration of a commercial or industrial building shall be valid for 12 months from the date of registration. The owner or creditor shall renew the registration every 12 months so long as the property meets the criteria requiring registration as established by this article.  The owner or creditor shall pay a renewal registration fee in the same amount as the initial registration fee.
