Greece, NY

The town of Greece, N.Y. has amended its property registration ordinance to eliminate the $10,000.00 bond requirement.  Annual registration is required within 45 days of vacancy and/or default and is accompanied by a fee of $500.00.

Property Registration Ordinance

A local law amending Part II, General Legislation of the code of the Town of Greece, Chapter 157, Property Maintenance, to create increased penalties for repeated noncompliance with the Property Maintenance Code, and amending Part II, General Legislation of the code of the Town of Greece to include Chapter 194, Vacant and Defaulted Mortgage Property Registry, to establish a vacant and defaulted mortgage registry and to require lenders to provide funds to secure maintenance of a property upon commencing foreclosure proceedings.

Chapter 194:  VACANT AND DEFAULTED MORTGAGE PROPETY REGISTRY

Sec. 194-5  Registration of Vacant and/or Defaulted Mortgage Real Property.

A.  Any owner of any vacant residential structure located within the Town shall, within forty-five (45) days of the structure becoming vacant, register said residential structure with the Office of the Building Inspector, or its designee, on forms or other manner as directed.  A separate registration is required for each vacant residential structure.

H.  A non-refundable annual registration fee established by resolution by the Town Board, shall accompany each registration pursuant to this section.

Vallejo, CA

The city of Vallejo, Calif. has amended its property registration requirement to reflect a fee of $453.00.  The program continues to require annual registration within 10 days of vacancy or notice of default.

AND ORDINANCE OF THE CITY OF VALLEJO AMENDING CHAPTER 7.62 OF TITLE 7 (VACANT BUILDINGS) OF THE VALLEJO MUNICIPAL CODE

SECTION 2.  Section 7.62.035 of the Vallejo Municipal Code is hereby added to read as follows:

7.62.035    Registration requirements for vacant and foreclosed residential buildings

C.     The registration requirement is triggered within 10 days after either of the following occurs:

1) The building become a "vacant building" subject to this section or

2) A Notice of default has been recorded.

F.     The Vallejo City Council shall establish a registration fee by resolution.  An annual registration fee per property shall accompany the registration form.  The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required.  Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31 of the year due.  Registration fees will not be prorated.

Decatur, IL

The city of Decatur, Ill. has enacted a property registration requirement within 15 days of foreclosure filing or 30 days of vacancy.  The program will require semi-annual registration accompanied by a $200.00 fee for residential properties and a $350.00 fee for commercial properties.

(c)  Within fifteen (15) days of the date any mortgagee files a foreclosure action, the mortgagee shall register the real property with the City Registry, and, at the time of registration, indicate whether the property is vacant, and if so, shall designate in writing a property manager to inspect, maintain, and secure the real property subject to the mortgage under a foreclosure action.  A separate registration is required for each property under a foreclosure action, regardless of whether it is occupied or vacant.

(e)  At the time of initial registration each registrant shall pay a non-refundable semi-annual registration fee of Two Hundred Dollars ($200.00) for each Residential property, and Three Hundred Fifty Dollars ($350) for each Commercial Property.  Subsequent non-refundable semi-annual renewal registrations of properties shall be the same as initial fees and fees are due within ten (10) days of the expiration of the previous registration.

Rochester, NY

The city of Rochester, N.Y. has enacted a property registration requirement within 60 days of vacancy.  The program will require annual registration accompanied by the following escalating fee structure:

Initial Registration: $250.00
1st Renewal: $500.00
2nd and Subsequent Renewals: $1,000.00

C.  Vacant building registration.  With the exception of exemptions specified in Subsection F herein, the owner or owners of a vacant building (hereinafter referred to individually and collectively as "the owner") shall register such building with the Commissioner of the Department of Neighborhood and Business Development (Commissioner) no later than 60 days after the building becomes vacant and shall renew the registration on an annual basis thereafter for so long as the building remains vacant.

(3)  Registration fee.  Each registration, whether it be initial or renewed, shall be accompanied by the payment of a registration fee that is based on the type and the tenure of the vacant building in accordance with the following fee schedule:

Year 1: Initial Registration                                                                            $250

The city of Millville, N.J. has amended its property registration requirement to reflect an annual fee of $500.00 for occupied properties and an additional $2,000.00 for vacant properties.  The program continues to require annual registration within 10 days of foreclosure filing or vacancy.

ARTICLE V

Vacant Property Registration and Maintenance Requirements

Sec. 11-48.  Registration requirements for abandoned real property.

A.  Any mortgagee who holds a mortgage on real property located within the City of Millville shall perform an inspection of the property to determine vacancy or occupancy upon a filing of a summons and complaint.  The mortgagee shall, within 10 days of the inspection, register the property with the City Code Enforcement Office, or designee, using the website access provided by the City of Millville, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

B.  If the property is occupied, it shall be inspected by the mortgagee or his designee monthly until:

(1)  The mortgagor or other party remedies the default; or

(2)  It is found to be vacant or shows evidence of vacancy, at which time it is deemed abandoned, and the mortgagee shall, within 10 days of that inspection, update the property registration to a vacancy status.

D.  A nonrefundable annual registration fee of $500 shall be collected per property and shall accompany the website registration.  An additional fee of $2,000 per property annually if the property is vacant or abandoned pursuant to the above definition when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in this article at any time thereafter while the property is in foreclosure.

San Francisco, CA

The city of San Francisco, Calif. has amended its property registration requirement to reflect an annual fee of $818.00.  The program will continue to require annual registration within 30 days of vacancy.

ORDINANCE NO. 194-09

[Building Code - Registration of Vacant/Abandoned Buildings; Maintenance and Security Requirements; Annual Fee and Penalties for Violation.]

Ordinance amending the San Francisco Building Code by adding Section 103A.4 to require the owner of a vacant or abandoned building to register the building with the Department of Building Inspection, require the owner to maintain the grounds and the exterior and interior of the building secured and in good condition, and provide that a property in violation of the requirements is a public nuisance; and by amending Section 110, Table 1A-J to establish an annual registration fee; adopting environmental and other findings.

103A.4.2.  Property owner's obligation to register a vacant or abandoned building.  The owner of a building defined as vacant or abandoned under Section 103.A.4.1 shall register that building with the Department 30 days after it has become vacant or abandoned on a form provided by the Department.  The form shall describe the methods by which the owner has secured the property against unauthorized entry, declare any future plans for the property, state whether or not there is fire and liability insurance coverage, and provide such other information as the Department may require.  A registration fee shall be paid at the time of registration and annually thereafter.  See Section 110A, Table 1A-J for applicable fee.
