AN ORIDNANCE AMENDING CHAPTER 8-32 OF THE MUNICIPAL CODE OF HARVEY CONCERNING UNSECURED BUILDINGS, VACANT PROPERTIES, FORECLOSED PROPERTIES AND RENTAL PROPERTIES
SECTION 8-32-026 Inspection and registration of foreclosure or defaulted mortgage.
C. Within ten (10) days of the date any mortgagee files a foreclosure action or declares its mortgage to be in default or defaulted, the mortgagee shall register the real property with the city of Harvey registry, and, at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain and secure the real property subject to the mortgage in default or foreclosure action.
E. At the time of initial registration each registrant shall pay a nonrefundable semi-annual registration fee as set forth in the fee schedule, which may be amended from time to time by the city council, for each registrable property. Subsequent semi-annual registrations of defaulted properties and fees are due within ten (10) days of the expiration of the previous registration.
8-32-027 Inspection and registration of real property that is not subject to a mortgage in foreclosure.
A. Any owner of vacant property located within the city shall, within ten (10) days after the property becomes vacant, register the real property with the city registry.
C. At the time of initial registration each registrant shall pay a nonrefundable semi-annual registration fee for each vacant property. Subsequent semi-annual registrations of vacant properties and fees are due within ten (10) days of the expiration of the previous registration.

AN ORDINANCE OF THE TOWN OF HACKETTSTOWN AMENDING ARTICLE 7 (VACANT PROPERTY MAINTENANCE), OF CHAPTER 7 (BUILDING REGULATIONS) OF THE CODE OF THE TOWN OF HACKETTSTOWN REGARDING THE REGISTRATION OF VACANT AND FORECLOSED PROPERTIES TO BE CONSISTENT WITH P.L. 2021, C. 444
Sec. 7-73A. Registration of Property.
a) Any creditor who holds a mortgage or equity lien on real property located within the Town shall perform an inspection of the property to determine vacancy or occupancy, upon the commencement of foreclosure as evidenced by a foreclosure filing. The creditor shall, within ten (10) days of the inspection, register the property with the Town Code Enforcement Official, or its designee, on forms or website access provided by the town, and indicate whether the property is vacant or occupied. A separate registration is required for each property, whether it is found to be vacant or occupied.
b) If the property is occupied but remains in foreclosure, it shall be inspected by the creditor or his designee monthly until (1) the mortgagor or other party remedies the foreclosure, or (2) it is found to be vacant or shows evidence of vacancy at which time it is deemed abandoned, and the mortgagee shall, within ten (10) days of that inspection, update the property registration to a vacancy status on forms provided by the Town.
d) A non-refundable annual registration fee in the amount of $500.00 per property, shall accompany the registration form or website registration. On each anniversary date of the initial registration, the creditor shall submit a renewal registration and fee as follows: (1) $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor; and (2) an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in the ordinance when the summons and complaint in an action foreclose is filed, or becomes vacant and abandoned pursuant to the definition in this ordinance at any time thereafter while the property is in foreclosure.

The village of South Holland, Ill. has amended its property registration ordinance to require a semi-annual fee of $300.00. Registration will continue to be required within 10 days of foreclosure filing.

Sec. 9-75.4. - Registration of defaulted mortgaged real property.
a. Any mortgagee who holds a mortgage on real property located within the village shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgage. The mortgagee shall, within ten (10) days of the inspection, register the property, and indicate whether the property is vacant or occupied. A separate registration is required for each property, whether it is found to be vacant or occupied.
f. A non-refundable semi-annual registration fee of three hundred dollars ($300.00) shall accompany each registration pursuant to this section.
The city of Modesto, Calif. has amended its property registration ordinance to reflect an annual fee of $238.00. Registration will continue to be required within 10 days of vacancy.

Article 6. - Registration of Vacant Properties
4-12.603 - Registration.
Any beneficiary/trustee, who holds a deed of trust on a property located within the City of Modesto, shall perform an inspection of the property that is the security for the deed of trust, upon default by the trustor, prior to recording a notice of default with the Stanislaus County Recorder's Office. If the property is found to be vacant or shows evidence of vacancy, it is, by this chapter, deemed abandoned and the beneficiary/trustee shall, within ten (10) days of the inspection, register the property with the City Manager, or his/her designee, on forms provided by the City.
(a) If the property is occupied but remains in default it shall be inspected by the beneficiary/trustee, or an agent/designee of the beneficiary/trustee, monthly until (1) the trustor or another party remedies the default; or (2) the foreclosure is completed and ownership is transferred to a new owner who is not the former beneficiary or trustee; or (3) it is found to be vacant or shows evidence of vacancy at which time it is deemed abandoned, and the beneficiary/trustee shall, within ten (10) days of that inspection, register the property with the City Manager, or his/her designee, on forms provided by the City.
(d) The annual registration fee established by the City Council resolution, shall accompany the registration form. The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required. Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31st of the year due.

STATEMENT OF INTENT
Applications must have all applicable fields completed and legible, with required supporting documentation attached to the application. Approved applications are valid for the current calendar year from the date of approval. It is the responsibility of the property owner, trustee, and/or beneficiary to renew the registration annually prior to expiration of the current registration, and at the sale and/or transfer of the property. Fees are due according to the quarterly filing date schedule below.
