The township of Washington Township, N.J. has amended its property registration ordinance to require registration within 10 days of foreclosure filing.  The program will be accompanied by an annual fee of $500.00 for occupied properties and an additional $2,000.00 for vacant properties.

ORDINANCE AMENDING CHAPTER 179 OF THE CODE OF THE TOWNSHIP OF WASHINGTON ENTITLED "ABANDONED REAL PROPERTY"

Sec. 179-85   Registration, notice and other creditor requirements.

b.  Within ten (10) days of filing a summons and complaint with the New Jersey Superior Court in an action to foreclose on a commercial and/or residential mortgage for a property located within the Township, the creditor shall notify the Township Clerk, or his/her designee, of the action.

Sec. 179-86   Fees.

b.  Creditors required to notify the Township and register a property as one in foreclosure shall be required to pay an annual registration fee of five hundred dollars ($500.00) per property, due at the time of registration.

c.  If a property registered with the Township's registration program pursuant to Sec 179-84 and Sec. 179-85 as a property in foreclosure is determined to be vacant and abandoned at the time of registration, or becomes vacant and abandoned at any time during the pendency of the foreclosure proceeding, the creditor shall pay an additional annual registration fee of two thousand dollars ($2,000) per property, due at the time the determination that the property is vacant and abandoned is made.

Madera County, CA

The County of Madera, Calif. has amended its property registration requirement to reflect an annual fee of $208.00.  The program will continue to require registration within 10 days of vacancy/abandonment.

Chapter 7.40

REGULATION OF ABANDONED AND DISTRESSED RESIDENTIAL PROPERTIES

7.40.040 - Registration and Fees.  Any beneficiary/trustee who holds a deed of trust on a property located within the unincorporated territory of the County of Madera shall perform an inspection of the property that is the security for the deed of trust upon default by the trustor and prior to recording a Notice of default with the Madera County Recorder's Office.

A.  If the property is found to be vacant or shows evidence of vacancy, it shall be deemed abandoned and the beneficiary/trustee shall, within ten (10) days of the inspection, register the property with the Madera County Planning Department or its Code Enforcement Division on forms provided by the County of Madera.

D.  The fee for registering an abandoned residential property shall be set and amended from time to time by resolution of the Board of Supervisors.  An annual registration fee shall accompany the registration form.  The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required.  Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31 of the year due.  Registration fees will not be prorated.

Notice of Fee Increase

This notice is hereby provided that beginning January 1, 2024, the increased amount for abandoned home registration is $208.00.  This annual registration fee shall accompany the registration form.  The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required.  Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31 of the year due.

Crystal, MN

The city of Crystal, Minn. has amended its property registration requirement to reflect an annual fee of $1,000.00.  The program will continue to require registration within 30 days of vacancy.  If registration is not completed by the property owner and the city does so administratively, an additional $100.00 fee will be incurred.

4350.05.  Vacant building registration.  Subdivision 1.  Application.  The owner or responsible party shall register a vacant building with the city no later than 30 days after the building becomes vacant.

The village of Carey, Ohio has enacted a property registration requirement within 30 days of foreclosure filing.  The program does not require a registration fee.

The city of Forest Park, Ohio has amended its property registration requirement to reflect a $500.00 semi-annual registration fee.  The program will continue to require registration within 10 days of vacancy or foreclosure filing.

CHAPTER 153: REGISTRATION OF FORECLOSING MORTGAGED PROPERTY AND VACANT PROPERTY

Sec. 153.06 INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE.

(C)  Registration required.  Within ten days of the date any mortgagee files a foreclosure action, the mortgagee shall perform all of the following:

(1) Register the real property with the city registry; and

(2) At the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain, and secure the real property subject to the mortgage under a foreclosure action.

(F)  Existing properties; renewal.  Each individual property on the registry that has been registered for 12 months or more prior to the effective date shall have 30 days to renew the registration and pay the non-refundable semi-annual registration fee.  Properties registered less than 12 months prior to the effective date shall renew the registration every six months from the expiration of the original registration renewal date and shall pay the non-refundable semi-annual registration fee.

Sec. 153.07 INSPECTION AND REGISTRATION OF REAL PROPERTY NOT SUBJECT TO A MORTGAGE IN FORECLOSURE.

(A)  Registration required.  Any owner of vacant property located within the city shall within ten days after the property becomes vacant, register the real property with the city registry.

The city of Oneida, N.Y. has enacted a property registration requirement within 30 days of vacancy.  The program will require annual registration and will be accompanied by the following escalating fee schedule:

Year 4: $3,000.00

ARTICLE IV

Vacant Building Registry and Maintenance

Sec. 34-17.  Vacant building registration.

A.  The owner of a vacant building shall register with the Property Manager not later than 30 days after any building in the City becomes a vacant building or not later than 30 days after being notified by the Property Manager of the requirement to register.  From the information collected, the Property Manager shall maintain a database of vacant properties.  The Property Manager, or the enforcement officer, may identify vacant buildings through their routine inspection process as well as through notification by residents, neighborhood associations and other community groups that a building may be eligible for inclusion on the registry.  The database of vacant properties shall be made readily available to the Bureau of Fire, Police Department, City Engineer, Housing Inspector and Code Enforcement Officer, as necessary.

Sec. 34-18.  Vacant building registration fees; vacant building file.

A.  Fees.

(1)  The owner of a vacant building shall, within 30 days of the building becoming vacant, pay an annual fee in an amount to be established by resolution of the Common Council.  An annual fee shall thereafter be due and payable each year thereafter that the building remains vacant upon the same date as the first annual fee became due.  The fee shall be reasonably related to the administrative costs for registering and processing the vacant building owner registration form and for the costs incurred by the City in monitoring the vacant building site.

The owner of a vacant building shall pay a fee as set forth below:

FEE SCHEDULE

Year 1: $250.00 - Paid no later than 30 days after building become vacant.  Owner is subject to a fine if fee is not paid 30 days of becoming due.  If a plan is extended beyond 365 days, subsequent annual fees shall be paid as follows:

Year 2: $1,000.00

Year 3: $2,000.00

Year 4: $3,000.00

Year 5: $4,000.00
