The city of Markham, Ill. has enacted a property registration ordinance requirement within 10 days of foreclosure.  The program will require a semi-annual registration accompanied by a $500.00 fee.

(C) Registration of Real Property Under Foreclosure

(2)  Real property within the City shall be registered under this Subsection by the Mortgagee within 10 days of the Mortgagee filing a Foreclosure Action

(3)  At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of five hundred dollars ($500.00) for each Registrable Property.  Subsequent non-refundable Semi-Annual Registrations of properties and fees in the amount of five hundred dollars ($500.00) are due within ten (10) days of the expiration of the previous registration.

Miami Lakes, FL

The town of Miami Lakes, Fla. has enacted a property registration ordinance requirement within 10 days of foreclosure filing or within 10 days of vacancy.  The program will require a semi-annual registration accompanied by a $250.00 fee.

AN ORDINANCE OF THE TOWN OF MIAMI LAKES, FLORIDA; AMENDING CHAPTER 16, CREATING ARTICLE IV TO BE ENTITLED, "REGISTRATION OF FORECLOSURE MORTGAGES AND VACANT PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES AND VACANT PROPERTY BY OWNERS; PROVIDING FOR PENALITIES  AND ENFORECEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE TOWN; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.

ARTICLE IV - Registration Of Foreclosing Mortgages And Vacant Property

Sec. 16-54.- INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE

(b)  Property inspected pursuant to subsection (a) above that remains in Foreclosure shall be inspected every thirty (30) days by the Mortgagee or Mortgagee's designee.  If an inspection shows a change in the property's occupancy status the Mortgagee shall, within ten (10) days of that inspection, update the occupancy status of the property registration.

(c)  Within ten (10) days of the date a Mortgagee files a Lis Pendens with respect to a property subject to a Foreclosure Action (or, if no Lis Pendens is filed, within ten (10) days of any public filing by a Mortgagee evidencing the commencement of a Foreclosure Action with respect to the property), the Mortgagee shall register the Real Property with the Town Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action.  A separate registration is required for each property subject to a Foreclosure Action, regardless of whether the property is occupied or vacant.

(e)  At the time of the registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $250.00 for each property.  Subsequent non-refundable Semi-Annual renewal registration of properties and fees in the amount of $250.00 are due within ten (10) days of the expiration of the previous registration.

Garwood, NJ

The borough of Garwood, N.J. has amended its property registration requirement to within 10 days of foreclosure.  The program will require an annual registration accompanied by a fee of $500.00 for occupied properties or $2500.00 for vacant properties.

ORDINANCE NO. 23-01

AN ORDINANCE AMENDING THE BOROUGH CODE OF THE BOROUGH OF GARWOOD BY AMENDING CHAPTER 67, ENTITLED "BUILDING AND STRUCTURE", ARTICLE VII, ENTITLED "MAINTENANCE, REGISTRATION AND REPAIR OF RESIDENTIAL PROPERTIES SUBJECT TO FORECLOSURE".

Maintenance, Registration and Repair of Residential Properties Subject to Foreclosure

[Added 1124-2015 by Ord. No. 15-22; amended 9-11-2018 by Ord. No. 18-21; amended 2-9-2023 by Ord. No. 23-02]

Sec. 67-17 Notice required.

A.  A creditor serving a summons and complaint in an action to foreclose on a mortgage on residential or commercial property in the Borough of Garwood shall, within 10 days of serving the summons and complaint, notify the Borough Clerk and Mayor.

Sec. 67-18 Registration required.

A.  A creditor serving a summons and complaint in an action to foreclose on a mortgage of residential or commercial property in the Borough of Garwood shall, within 10 days of serving the summons and complaint, shall register such residential or commercial property with the Borough Clerk.

C.  The registration shall remain valid for one year from the date of registration, except for the initial registration which shall be prorated on a monthly basis through December 31.  The creditor shall be required to renew the registration annually as long as the building remains a vacant and abandoned property and shall pay a registration or renewal fee in the amount prescribed in Sec, 67-27.1 for each vacant property registered.

Sec. 67-27.1 Registration and renewal fee schedule.

The registration and renewal fee for each building, subject to subsection 67-18 shall be $500 per annum.  For each building that is vacant and abandoned, the fee is an additional $2,000 per annum.

South Chicago Heights, IL

The village of South Chicago Heights, Ill. has amended its property registration requirement to within 10 days of notice of default.  The program will require semi-annual registration with the following escalating fee schedule:

Initial Registration: $250.00
1st Renewal: $250.00
2nd Renewal: $250.00
3rd and Subsequent Renewals: $300.00

Sec. 14-11. - Foreclosure and mortgage default regulations.

(c)  Within ten days of the date any mortgagee declares its mortgage to be in default or defaulted, the mortgagee shall register the real property with the village's registry, and at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain and secure the real property subject to the mortgage in default or defaulted.  A separate registration is required for each defaulted property.

(e)  At the time of the initial registration each registrant shall pay a non-refundable semi-annual registration fee of $250.00 for each defaulted property.  Subsequent semi-annual registrations of defaulted properties and fees in the amount of $250.00 are due within ten days of the expiration of the previous registration.  Any registerable property remaining vacant after two years shall pay subsequent registration fees in the amount of $300.00 semi-annually as provided by this chapter.
