The city of Edgewater, Fla., has enacted property registration requirements within 10 days of foreclosure filing. The program will be enforced through a third-party service provider (ProChamps) and will include a $300 semi-annual fee.

Sec. 12-115. - Inspection and registration of real property in foreclosure

(c)Within ten days of the date any mortgagee files a foreclosure action, the mortgagee shall register the real property with the city registry, and, at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain and secure the real property subject to the mortgage in foreclosure when legally possible. A separate registration is required for each registrable property.

Upper Darby, PA

The Township of Upper Darby, Pa., has amended its property registration ordinance to reflect an increased, semi-annual $200 fee (previously an annual $200 fee). The program will be enforced through a third-party service provider (ProChamps). The change became effective on October 4.

SECTION 3. Registration of foreclosed real property.
A. Mortgage Foreclosed Properties

1. Any mortgagee who holds a mortgage on real property located within Upper Darby Township shall perform an inspection of the prope1ty to determine vacancy or occupancy, upon default by the mortgagor, as evidenced by a foreclosure filing. The mortgagee shall, within ten (10) days of the inspection, register the property with the Department of License and Inspection or its designee in a form provided by the Township, and indicate whether the property is vacant or occupied. A separate registration is required for each property, whether it is found to be vacant or occupied.

4. At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee for each property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees are due within ten (10) days of the expiration of the previous registration.

Apopka, FL

The City of Apopka, Fla., has amended its property registration ordinance to reflect an increased, semi-annual $200 fee (previously an annual $200 fee). The program will be enforced through a third-party service provider (ProChamps). The change became effective on October 4.

Sec. 38-168. - Registration of abandoned real property.
(a)Any mortgagee who holds a mortgage on real property located within the city shall, upon default by the mortgagor, and prior to the issuance of a notice of default, perform an inspection of the property that is the security for the mortgage. If the property is found to be vacant or shows evidence of vacancy, it shall be deemed abandoned real property and the mortgagee shall, within ten days of the inspection, register the property with the mayor, or his designee, on forms provided by the city. A registration is required for each property, whether vacant or occupied.

(b)If the property is occupied but the mortgage on the property remains in default, the property shall be inspected by the mortgagee or his designee monthly until:

(1)The mortgagor or other party remedies the default; or

(2)It is found to be vacant or shows evidence of vacancy at which time it is deemed abandoned, and the mortgagee shall, within ten days of that inspection, update the property registration to a vacancy status providing the date of last inspection with the mayor, or his designee, on forms provided by the city

(c)Registration pursuant to this section shall contain the name of the mortgagee and the servicer, the direct mailing address of both parties, a direct contact name and telephone number for both parties, a facsimile number and e-mail address for both parties, the folio or tax number, and the name and 24-hour contact telephone number of the property management company responsible for the security and maintenance of the property.

(d)This section shall also apply to properties that have been the subject of a foreclosure sale where the title was transferred to the beneficiary of a mortgage involved in the foreclosure and any properties transferred under a deed in lieu of foreclosure/sale.

(e)A registration fee in the amount of $200.00 per property shall accompany the registration form.

(f)Properties subject to this section shall remain under the registration requirement, security and maintenance standards of this section as long as they remain vacant.
