The village of Brooklyn, Ill. has enacted a property registration requirement within 30 days of vacancy or foreclosure filing.  The program will require semi-annual registration accompanied by a fee of $250.00.

ORDINANCE NO. 2024-08

AN ORDINANCE OF THE VILLAGE OF BROOKLYN, ILLINOIS, REQUIRING REGISTRATION OF CERTAIN VACANT AND FORECLOSING PROPERTIES.

Section 3. Registration.

1.  Owners and/or creditors shall register any residential, commercial, or industrial property that is vacant within 30 days with the Clerk's Office of the Village of Brooklyn.  Registration is also required upon filing a notice of default for any property.

4.  Registration much be renewed every 6 months, with a renewal fee of $250.00.

Altoona, PA

The city of Altoona, Pa. has amended its property registration ordinances to reflect updated annual fees.  The program will continue to require annual registration within 10 days of foreclosure filing or within 10 days of vacancy for properties in default, or after 180 days of vacancy for properties not in default.  For properties in foreclosure, the program will require a $500.00 annual fee. Vacant properties will be subject to the following escalating fee structure:

Initial Registration: No Fee
1st Renewal: $500.00
2nd Renewal: $1,000.00
3rd & 4th Renewal: $2,000.00
5th - 9th Renewal: $3,500.00
10th and Subsequent Renewals: $5,000.00

Chapter 560  Registration of Properties in Default of Mortgage

Sec. 560-5  Registration requirements of abandoned real property.

A.   Any mortgagee who holds a mortgage on a real property located within the City shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor.  The mortgagee shall, within 10 days of the inspection, register the property with the Department of Code Enforcement (DCE), or designee, on forms or website access provided by the City, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

B.  If the property is occupied but remains in default, it shall be inspected by the mortgagee or the mortgagee's designee monthly until 1) the mortgagor or other party remedies the default, or 2) it is found to be vacant or shows evidence of vacancy at which time it is deemed abandoned, and the mortgagee shall, within 10 days of that inspection, update the property registration to a vacancy status on forms provided by the city.

E.  Properties subject to this section shall remain under the annual registration requirement, and the inspection, security and maintenance standards of this section as long as they remain vacant or in default.

Sec. 560-15  Fees.

A nonrefundable registration fee in the amount established by the resolution of City Council from time to time shall accompany the registration form.

Chapter 563  Registration of Vacant Buildings

Article I  Vacant Building Registry

Sec. 563-2  Applicability

The requirements of this article shall be applicable to each owner of any building that is not a dwelling that shall have been vacant for more than 180 consecutive days and to each owner of residential property consisting of one or more vacant dwellings that shall have been vacant for more than 180 consecutive days.  Registration shall be required for all vacant buildings, whether vacant and secure, vacant and open, or vacant and boarded, and shall be required whenever any building has remained vacant for 180 consecutive days or more.

Sec 563-4  Registration statement; local agent and registration; fee schedule.

A.  Registration statement.  Each such owner shall cause to be filed a registration statement, which shall include the street address and parcel number of each such vacant building, the names and addresses of all owners, as hereinafter described, and any other pertinent information deemed necessary by the department.  The registration fee(s) as required by this chapter shall be billed by the Department and shall be paid by January 1 of each year.

C.  Registration fee schedule.  The owner of the vacant property as of November 15 of each calendar year shall be responsible for the payment of the nonrefundable registration fee.  Said fee shall be billed by the Department and based on the duration of the vacancy as determined by resolution of City Council from time to time.

Mount Clemens, MI

The city of Mount Clemens, Mich. has amended its property registration ordinance to reflect an updated annual fee of $500.00 for residential properties and $1,000.00 for commercial properties.  The program will continue to require registration within 30 days of vacancy.

18.502 - Sec. 2.

REGISTRATION OF ABANDONED AND VACANT PROPERTIES.

Owners of abandoned and/or vacant properties shall register such properties as required by this Chapter.  Registration requirements will not preclude the City from taking appropriate actions to secure the property or to issue orders to repair or abate upon imminent hazard(s).

18.504 - Sec. 4.

ABANDONED RESIDENTIAL STRUCTURE FEES.

A fee may be charged to defray the City's cost of monitoring abandoned and/or vacant residential structures.  All such fees shall be set by resolution of the City Commission.

Mount Olive Township, NJ

The township of Mount Olive, N.J. has enacted a property registration requirement upon foreclosure filing.  The program will require annual registration accompanied by a fee of $500.00 for occupied properties and an additional $2,000.00 if the property is vacant or abandoned.

Chapter 302 Article IV Vacant and Abandoned Property Registration Program

Sec. 302-57 Residential or commercial foreclosures.

A.  The creditor filing a summons and complaint in an action to foreclose shall, in addition to the notice provided to the municipality pursuant to N.J.S.A. 46:10B-51, register the residential or commercial property with the Township's property registration program as a property in foreclosure.

F.  Fees.  The creditor will pay an annual registration fee of:

(1)  $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor.

(2)  An additional $2,000 per property annually if the property is vacant or abandoned when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in this article at any time thereafter while the property is in foreclosure.

The city of Bangor, Maine has amended its property registration ordinance to reflect the following escalating fee schedule.  The program will continue to require semi-annual registration within 60 days of vacancy.

Initial Registration: $500.00
1st Renewal: $1,000.00
2nd Renewal: $2,000.00
3rd and Subsequent Renewals: $4,000.00

Article II  Vacant Buildings

Sec. 223-8  Registration required.

A.  The owner of a vacant building must obtain a vacant building registration permit for the period during which it is vacant.

B.  When a building or structure becomes vacant, the owner of the building must apply for and obtain a vacant building registration permit and pay the fee within 60 days of the building becoming vacant.

C.  Standard vacant building registration permit.

(2)  A standard vacant building registration permit is valid for six months from the date of approval.

Third 6 months -- $2,000.00

Fourth 6 months -- $4,000.00 and will be $4,000.00 every 6 months thereafter.

The township of Commercial, N.J. has amended its property registration ordinance to reflect the following escalating fee schedule.  The program will continue to require annual registration within 30 days of vacancy.

Chapter 252 Property, Vacant

Article I Registration and Maintenance of Vacant Property

Sec. 252-2  General requirements.

A.  Effective June 1, 2014, the owner of any vacant property as defined herein shall, within 30 days after the building becomes vacant property or within 15 days after assuming ownership of the vacant property, whichever is later, file a registration statement for each such vacant property with the Code Enforcement Officer on forms provided by that Code Enforcement Officer for such purposes.  The registration shall remain valid for one year from the date of registration.  The owner shall be required to renew the registration annually as long as the building remains vacant property; the owner then shall pay a registration or renewal fee.

Sec. 252-4  Fee schedule.

The initial registration fee for each building shall be $500.  The fee for the first renewal is $1,500 and the fee for the second renewal is $3,000.  The fee for any subsequent renewal beyond the second renewal is $5,000.
