The city of Council Bluffs, Iowa has enacted a property registration ordinance requirement within 120 days of vacancy.  The program will require annual registration accompanied by a $300.00 fee.

Chapter 17.15 - VACANT PROPERTY REGISTRATION

17.15.020 Applicability

The requirements of this chapter shall be applicable to each owner of a vacant property that has been unoccupied for more than 120 days, unless exceptions apply under the provisions of this Chapter.

17.15.040 Registration

A.  The owner of a vacant property located within the city shall register the property with the Director.

17.15.050 Fees

The fee for registering a vacant property and each annual renewal fee shall be set forth in CBMC 2.08, Schedule of Fees.

Carneys Point, NJ

The township of Carneys Point, N.J. has amended its property registration ordinance by suspending the collection of fees associated by the ordinance.   All registration/de-registration forms should still be submitted for the purpose of document retention and updates.

The township has suspended the collection of fees associated with the Vacant Property Ordinance, but we are still open to receive all registration/de-registration forms that are submitted for all vacant properties for the purpose of document retention and updates.  If and when the suspension is lifted, you will be notified accordingly.

Muncie, IN

The city of Muncie, Ind. has enacted a property registration ordinance requirement with an annual voluntary registration.  If the owner of a vacant property voluntarily renews a registration before May 10th of each year, a registration fee will not be incurred.  In the event the owner fails to renew a registration by May 10th of each year, the following escalating renewal fee schedule will be followed:

$100.00 if renewed between May 11th and June 9th;
$300.00 if renewed between June 10th and July 9th; 
$500.00 if renewed between July 10th and September 7th.

If the registration is not renewed by September 7th, the matter shall be referred to the unsafe building hearing authority.

Sec. 152.16. - Vacant and abandoned structures.

(B) Continuing maintenance mandatory and voluntary registration.
 
(3)  The owner of a structure that is a vacant structure, but not an abandoned structure, may voluntarily register the structure with the enforcement authority, so as to notify city officials of the property manager and exchange other information pertinent to the condition of the structure.
 
(E) Registration fee.
 
(1) The owner of any vacant and abandoned structure shall pay the registration fees set forth below to the City of Muncie through the enforcement authority.  The registration shall be renewed annually until such time that the structure is no longer declared to be a vacant and abandoned structure.
 
(2) Owners who voluntarily register a vacant structure, but not abandoned as defined in this chapter, are not required to pay a registration fee.
 
(3) Registration fees for a vacant and abandoned structure shall be as follows:
 
(a) There shall be no initial registration fee if the owner of a vacant and abandoned structure voluntarily registers the property on or before May 10, 2022.
 
(b) After May 10, 2022, the owner of a vacant and abandoned structure ordered to register by the enforcement authority that registers within the time provided in the order shall pay a $100.00 registration fee.  The registration fee shall increase to $300.00 if the owner does not register within the time provided in the order.  The registration fee shall increase to $500.00 if the owner does not register within 60 days after the expiration of the time provided in the order.  If the owner does not register within 120 days after the expiration of the time provided in the order, the matter shall be referred to the unsafe building hearing authority.
 
(c) The owner of a previously registered vacant and abandoned structure that voluntarily renews a registration before May 10th of each year that a renewal registration is required will not incur a registration fee.  In the event the owner fails to renew a registration by May 10th of each year, the renewal fee shall be as follows:
 
i.  $100.00 if renewed between May 11th and June 9th; 
ii.  $300.00 if renewed between June 10th and July 9th; and
iii.  $500.00 if renewed between July 10th and September 7th.
 
If registration is not renewed by September 7th, the matter shall be referred to the unsafe building hearing authority.

Colonie, NY

The town of Colonie, N.Y. has amended its property registration ordinance requirement to reflect an annual escalating fee structure as follows:

Initial Fee: $480.00
1st Renewal: $840.00
2nd Renewal: $1500.00
3rd Renewal: $2700.00
4th Renewal: $4020.00
5th-8th Renewal: $4740.00
9th and subsequent renewal: $6650.00; plus an additional $600.00 for each year in excess of 10 years.

Article V Registration of Abandoned/Vacant Real Property

Sec. 62-54 Registration.

A. Owner.  Every owner of real property located within the Town that is abandoned or vacant as those terms are defined herein shall register the property with the Town Building Department Manager or his or her designee on forms provided by the Town and shall pay the fees as required by this article.  A registration is required for each vacant property.

B. Mortgagee. Any mortgagee who holds a mortgage on real property located within the Town of Colonie upon default by the mortgagor and prior to the issuance of a notice of default or the filing of a lis pendens with the County Clerk, whichever is earlier, shall perform an inspection of the property that is the security for the mortgage.  if the property is found to be vacant or shows evidence of vacancy it shall be deemed abandoned/vacant real property and the mortgagee shall within 10 days of the inspection register the property with the Town Building Department Manager or his or her designee on forms provided by the Town and shall pay the fees as required by this article.

Sec. 62-56 Registration statement and fees; local agent.

If none of the persons listed above is shown at an address within the state, the registration statement also shall provide the name and address of a person who resides within the County of Albany, State of New York, and who is authorized to accept service of process on behalf of the owners or mortgagees and who shall be designated as a responsible, local party or agent, both for the purposes of notification in the event of an emergency affecting the public health, safety or welfare and for the purposes of service of any and all noticed or registration statements as herein authorized and in connection herewith.  Registration shall be required for all vacant and abandoned buildings, whether vacant and secure, vacant and open or vacant and boarded, and shall be required whenever any building has remained vacant for 35 consecutive days or more.  In no instance shall the registration of a vacant or abandoned building and the payment of registration fees be construed to exonerate the owner, agent or responsible party from responsibility for compliance with any other building code or housing code requirement.  One registration statement must be filed for each vacant building of the owner or mortgagee so registering and a separate fee paid therefor.  The owner or mortgagee of the vacant or abandoned real property as of the yearly anniversary date of the initial registration filing shall be responsible for the payment of the nonrefundable registration fee.  Said fee shall be established by separate Town Board resolution and shall be paid to the Town Clerk and shall be based on the duration of the vacancy as determined by said separate Town Board resolution.
