Laurel Springs Borough, NJ

The borough of Laurel Springs, N.J. has amended its property registration requirement to reflect and updated fee schedule of $500.00 annually for occupied properties and an additional $2,000.00 annually for vacant or abandoned properties.

ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 202 OF THE CODE OF THE BOROUGH OF LAUREL SPRINGS ENTITLED "REGISTRATION AND DEFAULTED MORTGAGE PROPERTY" - 870-2022

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE BOROUGH OF LAUREL SPRINGS, COUNTY OF CAMDEN, STATE OF NEW JERSEY, AS FOLLOWS:

SECTION 6.  Chapter 202, Section 2, Subsection 13, entitled "Enforcement and Penalties, " of the Code of the Borough of Laurel Springs is hereby amended and supplemented by the deletion of Subsections A (1) and (3), and by the addition of new Subsections H and I as follows:

H.    The Borough of Laurel Springs may impost an annual fee for Foreclosure properties with a filing to a mortgagee of up to $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor; and an additional $2,000 per property annually if the Foreclosure property is vacant or abandoned when the summons and complaint in an action to foreclosure is filed, or becomes vacant and abandoned while the property is in Foreclosure.

Elizabeth, NJ

The city of Elizabeth, N.J. has amended its property registration requirement to reflect an updated fee schedule of $500.00 annually for occupied properties or $2,000.00 annually for vacant properties.  Registration is required within 7 days of foreclosure filing.

Chapter 8.80 VACANT AND FORECLOSING PROPERTIES

8.80.030 Registration of vacant and/or foreclosing properties; duty to provide written notice of vacant property and/or mortgage foreclosure.

All owners must register vacant and not properly maintained properties with the department of planning and community development on forms to be provided.  All registrations must state the individual owners or agent's name, phone number and mailing address.  The mailing address may not be a P.O. Box.  This registration must also certify that the property was inspected and identify whether the property is vacant at the time of filing.  If the property is vacant, the owner and/or registrant must designate and retain an individual or property management company responsible for the security and maintenance of the property.  This designation must state the individual or company's name, phone number and local mailing address.  The mailing address may not be a P.O. Box.  If the property is in the process of foreclosure, then the registration must be received within seven (7) days of the initiation of the foreclosure process as defined in section 8.80.020.  If the enforcement authority determines that the property is vacant and the foreclosure proceedings have not been initiated, the registration must be received within fourteen (14) days of the enforcement authority's first notice of violations or summons for improper maintenance.  All owners must also provide proof of utility (gas, electric, water) connections or disconnections which must be submitted to the department of planning and community development.

All property registrations of properties subject to foreclosure are valid for one year from the date of registration.  The registration fee shall be five hundred dollars ($500.00) for occupied properties with renewals for occupied properties being five hundred dollars ($500.00) and two thousand dollars ($2000.00) for vacant properties with renewals being two thousand dollars ($2000.00) so long as the property remains vacant.  Registration fee and renewal fees will not be prorated or refunded.

Parsons, KS

The city of Parsons, Kan. has enacted a property registration requirement within 20 days of vacancy.  The program will require an initial six month registration accompanied by a $50.00 registration fee.  After initial registration, renewals become annual and are subject to a re-registration fee of $250.00.

ARTICLE II

Vacant Property Registration

Sec.473-11.  Registration and maintenance requirements for abandoned and chronically vacant buildings; fees.

A.  The owner of an abandoned or chronic vacant building shall register the building with the City within 20 days of service of a written notice provided to the owner or agent of the existence of the abandoned or chronic vacant building, or show cause, in writing, to the public officer as to why the building is not abandoned or chronically vacant.  If the owner contends that the building is neither abandoned nor chronically vacant then such owner shall provide the public officer with such information as the owner requests the public officer to consider in making his or her determination.  The public officer shall render his or her written decision within 10 days of the notice that the owner challenges the initial notice that the building was abandoned or chronically vacant.

C.  The initial registration period is for six months.  After the initial registration period has expired and for every subsequent year a building remains abandoned or chronically vacant beyond the initial registration period, the owner of the abandoned or vacant building must: 

(1) Re-register the building by paying the appropriate fees, and

(2) Submit an updated plan for either returning the building to appropriate occupancy or use, or marketing the property.

H.  The initial registration fee for an abandoned or chronic vacant building is $50 per residential building, and $100 per commercial building, which shall be collected by the City at the time of initial registration of the building.

I.  If a building remains abandoned or chronically vacant more than six months after initial registration, it shall be subject to a re-registration fee of $250 per year for a residential building and $500 per year for a commercial/industrial building.  Funds derived from said fee shall be used to offset the City's cost of inspections and incentives as found in Subsection D.

Mansfield Township, NJ

The township of Mansfield, N.J. has amended its property registration requirement to reflect an updated fee schedule of $500.00 annually for occupied properties and an additional $2,000.00 annually for vacant and abandoned properties.  Registration is required within 10 days of foreclosure filing.

ORDINANCE OF THE TOWNSHIP OF MANSFIELD, COUNTY OF WARREN, STATE OF NEW JERSEY, DELETING IN ITS ENTIRETY CHAPTER 270 ENTITLED 'RESIDENTIAL PROPERTY, VACANT AND ABANDONED', AND REPLACING SAME TO BE CONSISTENT WITH P.L.2021, C. 444

Sec. 270-4. Registration of Property.

a)  Any creditor who holds a mortgage or equity lien on real property located within the Township shall perform an inspection of the property to determine vacancy or occupancy, upon the commencement of foreclosure as evidenced by a foreclosure filing.  The creditor shall, within ten (10) day of the inspection, register the property with the Township Code Enforcement Official, or its designee, on forms or website access provided by the Township, and indicate whether the Property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

d)  A non-refundable annual registration fee in the amount of five-hundred dollars ($500.00) per property shall accompany the registration form or website registration.  On each anniversary date of the initial registration, the creditor shall submit a renewal registration fee as follows: 1) five hundred dollars ($500.00) per property annually for any property that is required to be registered because a summons and a complaint in an action to foreclose was filed by the creditor; and 2) an additional two thousand dollars ($2,000.00) per property annually if the property is vacant and abandoned pursuant to the definition in the ordinance when the summons and complaint in an action to foreclose is filed, or becomes vacant  and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure. 

 
 
 
 
 

Ocean Township, NJ

The township of Ocean, N.J. has amended its property registration requirement to reflect an updated fee schedule of $500.00 annually for occupied properties and an additional $2,000.00 annually for vacant and abandoned properties.  Registration is required within 10 days of foreclosure filing.

Sec. 280-21. Maintenance of vacant and abandoned properties.

E.  Inspection and registration of real property under foreclosure.

(1)  Any creditor or mortgagee filing a summons and complaint in an action to foreclose real property in the Township of Ocean shall, in addition to the notice provided to the municipality pursuant to N.J.S.A. 46:10B-51 or N.J.S.A. 40:48-2.12s2, register the residential or commercial property with the Township's property registration program within 10 days of filing the summons and complaint in an action to foreclose, as a property in foreclosure and, as part of that registration:

(a) Provide the Township with the information regarding the creditor required by N.J.S.A. 46:10B-51 or N.J.S.A. 40:48-2.12S2.;

(8)  At the time of initial registration, each registrant shall pay a nonrefundable annual registration fee of $500 for each property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor.  Subsequent nonrefundable annual registrations of properties and fees in the amount of 4500 are due within 10 days of the expiration of the previous registration.  An additional $2,000 per property shall be assessed annually if the property is vacant or abandoned pursuant to Sec. 280-21B when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to Sec. 280-21B at any time thereafter while the property is in foreclosure.  Said fees shall be deposited to a special account in the Township's department dedicated to the cost of implementation and enforcement of this article and fulfilling the purpose and intent of this article.  None of the funds provided for in this section shall be utilized for the legal defense of foreclosure actions.
