The town of West Springfield, Mass. has enacted a property registration ordinance requirement within 45 days of vacancy or commencing foreclosure action.  The program will require an annual registration with a fee of $250.00.

Sec. 105.4  Registration of Vacant Buildings Required.  All owners of vacant and/or foreclosing buildings shall register said buildings with the Town's Building Commissioner.

A. Registration.

1.  Within forty-five (45) days of a building becoming vacant and/or foreclosing, each owner of such vacant and/or foreclosing building shall register said building with the Building Commissioner.  All registrations must state the owner's name, mailing address, telephone number and e-mail address.  The mailing address shall not be a post office box.

B.  Registration Fees.

1.  All property registrations pursuant to this Regulation are valid for one (1) calendar year from the date when the registration is received by the Commissioner.  An annual registration fee of Two Hundred Fifty Dollars and Zero Cents ($250.00) must accompany the registration form.  Subsequent registrations and fees are due at least thirty (30) days prior to the date of expiration of the previous registrations.  Subsequent registrations must certify whether the property remains vacant and/or remains in foreclosure, as the case may be.

Southampton, NJ

The township of Southampton, N.J. has amended its property registration ordinance from a vacant jurisdiction to within 30 days of foreclosure filing.  The program requires annual registration with a fee of $250.00 for occupied properties and $2,250.00 for vacant properties.

ORDINANCE NO. 2022-09

AN ORDINANCE REPEALING, REPLACING AND AMENDING PORTIONS OF CHAPTER 8 OF THE CODE OF THE TOWNSHIP OF SOUTHAMPTON CONCERNING VACANT AND ABANDONED PROPERTIES

Sec. 8-7.13  Registration, Notice and other Creditor Requirements.

a.  Within 30 days of the effective date of this Ordinance, any creditor who has initiated a summons and complaint with the New Jersey Superior Court in an action to foreclose on a commercial and/or residential mortgage for a property located within the Township of Southampton: (i) prior to the effective date of this Ordinance, and (ii) which is pending as of the effective date of this Ordinance, shall provide notice in accordance with subsection (b) of Section 8-7.13.

Sec. 8-7.14  Fees. Violations and Penalties.

b.  Creditors required to notify the Township of Southampton and register a property as one in foreclosure shall be required to pay the following annual registration fee, per property, due at the time of registration: $250.00.

c.  If a property registered with the Township of Southampton's registration program as a property in foreclosure is vacant and abandoned at the time of registration, or becomes vacant and abandoned at any time during the pendency of the foreclosure proceeding, the creditor shall pay an additional annual registration fee, per property, due at the time the determination that the property is vacant and abandoned is made, of: $2000.00.

Palmdale, CA

The city of Palmdale, Calif. has amended its property registration ordinance to reflect an increased annual registration fee of $330.00.  The program will continue to require registration within 10 days of vacancy or upon foreclosure.

Chapter 8.38

VACANT AND ABANDONED PROPERTY REGISTRATION

8.38.030 Registration.

Any beneficiary/trustee, who holds a deed of trust on a property located within the City of Palmdale, shall perform an inspection of the property that is the security for the deed of trust, upon default by the trustor, prior to recording a notice of default with the Los Angeles County Recorder's Office.  If the property is found to be vacant or shows evidence of vacancy, it is, by this chapter, deemed abandoned and the beneficiary/trustee shall, within 10 days of the inspection, register the property with the Planning Director on forms provided by the City.

(D)  The annual registration fee established by the City Council resolution, shall accompany the registration form.  The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required.  Subsequent registrations and fees are due January 1st of each year and must be received no later than January 31st of the year due.
