Berlin, NJ

The borough of Berlin, N.J. has amended its property registration requirement from bi-annual to annual renewal. Fees have also been amended to reflect the following escalated fee structure:

Initial Registration: $1000.00
First Renewal: $2000.00
Second and Subsequent Renewals: $3000.00

Article X Vacant or Abandoned Properties

Sec. 246-31 Registration requirements.

A.  Within 30 calendar days after the building becomes vacant property; or

B.  Within 30 calendar days after assuming ownership of the vacant property, whichever is later; or

C.  Within 30 calendar days of receipt of notice by the municipality, file a registration statement for such vacant property with the Property Maintenance Inspector on forms provided by the Borough for such purposes in the manner set forth below.

(3)  The registration shall remain valid for one year from the date of registration, except the initial registration, for the fee prescribed in Sec. 246-37 for each vacant property registered.

Sec. 246-37 Fees.

A. The registration fee for each building shall be as follows:

  1. Initial registration fee: $1,000.
  2. If not paid within six months of notification by the Borough of Berlin, the registration fee shall increase to $1,500.

B.  The renewal fee for each building shall be as follows:

  1. First renewal fee: $2,000.
  2. Second and subsequent renewal fee: $3,000.

Buena Vista, NJ

The township of Buena Vista, N.J. has amended its property registration requirement to within 10 days of foreclosure filing. The escalated fee schedule has also been replaced by an annual fee of $500.00.

ORDINANCE NO. 116-2022

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 216 ENTITLED "PROPERTY, ABANDONED AND NUISANCE" OF THE CODE OF THE TOWNSHIP OF BUENA VISTA

Sec. 216-5. Registration Requirements of abandoned real property

A.  Any mortgagee who holds a mortgage on real property located within the Township of Buena Vista shall perform an inspection of the property to determine vacancy or occupancy, upon a filing of a Summons and Complaint.  The mortgagee shall, within 10 days of the inspection, register the property with the Buena Vista Township Code Enforcement Office, or designee, using the website access provided by the Township of Buena Vista, and indicate whether the property is vacant or occupied.

D.  A nonrefundable annual registration fee shall be collected as a pass through fee to the Third Party Administrator in the amount of $500 (per the State Legislation enacted on January 1`8, 2022) per property shall accompany the website registration.

Farmer City, IL

The city of Farmer City, Ill. has enacted a property registration requirement within 30 days of vacancy. The program will include semi-annual registration that will reflect the following escalating fee structure:

Initial Registration: $200.00
First Renewal: $250.00
Second Renewal: $300.00

Any structure vacant beyond 18 months will be considered abandoned and a public nuisance.

An Ordinance Establishing Regulations Governing the Registration, Maintenance, Security and Monitoring of Vacant Properties by their Owners

CHAPTER 97: REGISTRATION AND MAINTENANCE OF VACANT STRUCTURES AND PROPERTIES

SEC. 97.04 -- OBLIGATIONS OF OWNERS OF VACANT STRUCTURES

(a)  Within thirty (30) days of a structure becoming vacant, as defined herein, the owner of the structure shall apply for a Vacant Structure Registration Certificate and pay a fee of $200.  If the structure is still vacant at the time of expiration of the original Vacant Structure Registration Certificate (six (6) months as defined below), the owner shall immediately apply to renew the certificate.  At the City's sole discretion, renewal may be had upon demonstrated need for a maximum of two 6-month periods, for an aggregate maximum of eighteen (18) months total vacancy registration.  Renewed permits shall be subject to all conditions and obligations imposed by this chapter on the initial certificate, including the payment of a $250 fee at the first renewal and a fee of $300 at the second renewal.  It shall be the responsibility of the registered owner to file an amended registration within ten (10) days of any changed contained in the initial application, including occupancy or transfer.

Sec. 97.10 -- ENFORCEMENT AND PENALTIES

(c)  At the expiration of eighteen (18) months from the original issuance of the Vacant Structure Registration Certificate, the structure must be reoccupied, removed or demolished.  Any structure which is vacant beyond the eighteen (18) month maximum registration period shall be considered abandoned and a public nuisance and the City may pursue whatever legal action is afforded to it by law for the removal and/or abatement of public nuisance.
