Oakland, NJ Enacts Annual Property Registration Fee

The borough of Oakland, N.J., enacted a vacant property registration program to be filed within 10 days of filing foreclosure action that reflects the following escalating fee structure:
- $400.00 initial
- $800.00 first renewal
- $1600.00 all subsequent renewal

Sec.10-9.4Registration of Abandoned Real Property.
a.
Any mortgagee who holds a mortgage on real property located within the Borough shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor. The mortgagee shall, within 10 days of the inspection, register the property with the Construction Enforcement Department, on forms provided by the Construction Enforcement Department, and indicate whether the property is vacant or occupied. A separate registration is required for each property, whether it is found to be vacant or occupied.

A nonrefundable annual registration fee in the amount of $400 for the initial year or portion thereof per property shall accompany the registration form. The annual fee shall be $800 for the second year of registration, and $1,600 for each year of registration thereafter. The annual registration fee shall be due on January 1 of each subsequent year as long as the property remains abandoned.

Registration of a vacant building shall be valid for a period of six months. If the building is still vacant at the expiration of any six-month registration period and/or the requirements of the Vacant Building Plan are not completed, then the owner shall re-register such building with an updated Vacant Building Plan and pay another registration fee.

SEC 6 262-2. Definitions.
SEMI-ANNUAL REGISTRATION: six (6) months from the date of the first action that requires
registration. as determined by the Town. or its designee. and every subsequent six (6)
months the property is Registrable. The date of the initial registration may be different than
the date of the first action that required registration.
SEC 262-4. Inspection and Registration of Real Property under Foreclosure.
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the
Mortgagee shall register the Real Property with the Southampton Town Registry,
and, at the time of registration, indicate whether the property is Vacant, and if so
shall designate in writing a Property Manager to inspect, maintain and secure the
Real Property subject to the mortgage in Foreclosure when legally possible. A
separate registration is required for each Registrable Property.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of five hundred dollars ($500.00) for each Registrable
Property. Subsequent non-refundable Semi-Annual Registrations of properties and
fees in the amount of five hundred dollars ($500.00) are due within ten (10) days of
the expiration of the previous registration.
