The city of Beverly, N.J. has amended its property registration ordinance to reflect an annual fee of $500.00 for occupied properties in foreclosure and $2,500.00 for vacant properties in foreclosure.  The program will continue to require annual registration within 10 days of foreclosure filing or 30 days of vacancy.

ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF BEVERLY ESTABLISHING PROVISIONS FOR VACANT AND ABANDONED PROPERTY AND RESCINDING ALL PRIOR ORDINANCES CONCERNING SAME

Section 2.  Registration Statement.

A.  The Owner of a vacant and abandoned property that is vacant and abandoned on the effective date of P.L. 2021, c.444, shall file a certificate of registration with the Code Enforcement Officer, Public Officer or other designee.  The Owner of a property that becomes vacant and abandoned shall file a certificate of registration with the Code Enforcement Officer or designee after the property becomes vacant and abandoned or within 30 days after the responsible party assumes ownership of or responsibility for an already vacant and abandoned property.  The registration shall remain valid until the end of the calendar year.  The owner shall be required to renew the registration annually, no later than January 31 or by another date agreed upon by the City and the Creditor, as long as the building remains vacant and abandoned property and shall pay a registration or renewal fee in the amount prescribed in Section 4 of this chapter for each vacant and abandoned property registered.

Section 4. Fee schedule.

A.  A municipality may impose an annual fee on a creditor required to register a property.  The fee shall not exceed:

(1) $500 per property annually for any property that is required to be registered because of a summons and complaint in an action to foreclose was filed by the creditor; and

(2) an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in this ordinance when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.  All such annual fees and due dates thereof shall be identified in this ordinance.

Section 6. Foreclosure.

A.  A creditor serving a summons and complaint in an action to foreclose on a mortgage on a property in the City shall, within 10 days of serving the summons and complaint, notify the Municipal Clerk, and the Mayor or other chief executive officer of the municipality that a summons and complaint in an action to foreclose on a mortgage has been filed against the subject Property.

Englewood, NJ

The city of Englewood, N.J. has amended its property registration ordinance to reflect a registration requirement within 90 days of vacancy or foreclosure.  Registration will be required annually and will be accompanied by the following fee structures:

Vacant and Abandoned Property Not in Foreclosure:
Initial Registration - $250.00
1st Renewal - $500.00
2nd Renewal - $750.00

Properties in Foreclosure:
Occupied in Foreclosure: $500.00
Vacant in Foreclosure: $2,500.00

CITY OF ENGLEWOOD

ORDINANCE NO. 23-29

AN ORDINANCE OF THE CITY OF ENGLEWOOD, COUNTY OF BERGEN, STATE OF NEW JERSEY TO AMEND CHAPTER 319 PROPERTY REGISTRATION, OF THE GENERAL ORDINANCES OF THE CITY OF ENGLEWOOD

Sec. 319-3 Certificate of Registration for Vacant and Abandoned Property

(a) The responsible party for a vacant and abandoned property shall file a certificate of registration with the Code Compliance Official, designee or other authorized representative of the City within 90 days after the property becomes vacant and abandoned or within 30 days after the responsible party assumes ownership of or responsibility for an already vacant and abandoned property, whichever is later.

(e) An annual fee of $250 for a certificate of registration for a vacant and abandoned property shall be paid to the City of Englewood.

(f) If there is an outstanding property maintenance or code violation on a vacant and abandoned property that remains unabated at the time of renewal, the responsible party shall pay an additional $500.

(g) If there is an outstanding property maintenance or code violation on a vacant and abandoned property that remains unabated at the time of a subsequent renewal, the responsible party shall pay an additional fee of $750.

Sec. 319-5 Residential or Commercial Foreclosures

(a) The Creditor filing a summons and complaint in an action to foreclose shall, in additional to the notice provided to the municipality pursuant to N.J.S.A. 46:10B-51 register the residential or commercial property with the City's Property Registration Program as a property in foreclosure.

(f) Fees.  The creditor will pay an annual registration fee of:

1.  $500 per property annually for any property that is required to be registered because a summons or complaint in an action to foreclose was filed by the creditor.

2. an additional $2,000 per property annually if the property is vacant or abandoned when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.

Belen, NM

The city of Belen, N.M. has amended its property registration requirement to reflect an annual fee of $.50/square foot of vacant space and a renewal fee of $.25/square foot per year of vacancy.  The program requires annual registration of properties with vacant or foreclosed structures.  Failure to register shall empower the city of Belen to file a lien on the property.

AN ORDINANCE AMENDING ORDINANCE #2020-03 ENTITLED VACANT OR FORECLOSED STRUCTURE and REGISTRATION FEE

Chapter 15.14 - VACANT OR FORECLOSED STRUCTURE REGISTRATION

15.14.404 - Vacant or foreclosed structure registration.

A.  The current owner of a "vacant," or foreclosed structure, shall register the property containing that structure, provide the information required herein below in subsection B. and pay the filing registration fee prescribed in section 15.14.040. E of this chapter.  Failure to take any of these steps shall empower the city of Belen to record a lien as to the property and to foreclose any such lien in accordance with provisions applicable to such liens.  The city of Belen shall not be required to provide any notice prior to the filing of such a lien.

E.  Fees.  The amount of any fees due under the provisions of this chapter shall be as provided by Ordinance 2012-02 (Appendix A, Rate and Fee Table} which may be modified from time to time.

Hamilton Township, NJ

The township of Hamilton Township, N.J. has amended its property registration ordinance to reflect an annual registration requirement within 10 days of foreclosure filing.  The program will also require an annual fee of $500.00 for occupied properties in foreclosure and an additional fee of $2,000.00 for properties in foreclosure that are vacant.

Chapter 365 Registration and Maintenance of Foreclosure Mortgage Properties

Sec. 365-5 Inspection and registration of real property under foreclosure.

C.  Within 10 days of the date any mortgagee files a foreclosure action, the mortgagee shall register the real property with the Township Registry, and, at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain and secure the real property subject to the mortgage in foreclosure when legally possible.  A separate registration is required for each registrable property.

E.  A nonrefundable annual registration fee in the amount of $500 per property shall accompany the registration form or website registration; and an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in this chapter when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in this chapter at any time thereafter while the property is in foreclosure.  Said fees shall be used to offset the costs of: 1) registration and registration enforcement, 2) code enforcement and mitigation related to foreclosure properties, 3) post-closing counseling and foreclosure intervention limited to owner-occupied persons in default, which may not include cash and mortgage modification assistance, and 4) for any other related purposes as may be adopted.  None of the funds provided for in this section shall be utilized for legal defense of foreclosure actions.
