The township of North Bergen, N.J. has amended its property registration requirement to reflect an annual fee of $500.00 for occupied properties in foreclosure and $2,500.00 for vacant properties in foreclosure.  The program will continue to require annual registration within 10 days of foreclosure filing.Property Registration Ordinance

COUNTY OF HUDSON

A SUPERSEDING ORDINANCE REQUIRING THE REGISTRATION AND MAINTNENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES, PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF ABANDONED REAL PROPERTY WITHIN THE TOWNSHIP OF NORTH BERGEN

SECTION 6. REGISTRATION OF FORECLOSURE REAL PROPERTY

A.    Any Mortgagee who holds a mortgage on real property located within the Township shall perform an inspection of the property to determine vacancy or occupancy, immediately upon filing a summons and complaint in an action to foreclose on a mortgage on real Property in the Township.  The Mortgagee shall, within ten (10) days of the inspection, register the property with the Township Building Department, or its designee, on forms or other manner as directed, and indicate whether the property is vacant or occupied.  A separate registration shall be required for each property, whether it is found to be vacant or occupied.  The Mortgagee shall be responsible for the care, maintenance, security, and upkeep of the exterior of the Registrable Property if it becomes vacant and abandoned.

I.    A non-refundable registration fee of $500.00 shall accompany each registration pursuant to this section.

J.    Each Individual property on the Registry that has been registered for six (6) months or more prior to the Effective Date of this Ordinance shall have thirty (30) days to renew the registration and pay the non-refundable $500.00 annual registration fee.  Properties registered less than six (6) months prior to the Effective Date shall renew the registration upon expiration and every twelve (12) months thereafter and shall pay the non-refundable $500.00 annual registration fee.

K.    Where the Registrable Property is vacant or abandoned, the annual registration fee shall be $2,500.

Cleveland, OH

The city of Cleveland, Ohio has enacted a property registration requirement upon determination of vacancy. The program will require annual registration accompanied by a $70 fee for residential properties.

CHAPTER 3106 - REGISTRATION OF VACANT BUILDINGS AND CERTIFICATES OF COMPLIANCE FOR VACANT BUILDINGS

Sec. 3106.03 Vacant Building Registration Required

(a)    The Responsible Party shall register the vacant building with the Director of Building and Housing.  A vacant lot, defined as a parcel that does not contain any permanent lawful occupied structure, is not a vacant building.  A building with multiple residential units in which at least one unit is occupied is not a vacant building.  The Responsible Party shall maintain the vacant building registration up-to-date.

 (b)    An application for registration of a vacant building shall be submitted with the associated fee required in this chapter.

(c)    Registration shall remain valid for twelve (12) months from the date of issuance.  The Responsible Party shall renew the registration upon expiration for as long as the property remains vacant.

Sec. 3106.05 Bond Required for Registration of Non-Residential Property

(a)    Upon registration of a commercial, industrial, or other non-residential vacant building of under or equal to ten thousand (10,000) interior square feet, as of July 1, 2024, the Responsible Party shall provide a cash bond to the Director in the sum of five thousand dollars ($5,000.00).  Upon registration of a commercial, industrial, or other non-residential vacant building of over ten thousand (10,000) interior square feet, as of July 1, 2024, the Responsible Party shall provide a cash bond to the Director in the sum of fifteen thousand dollars ($15,000.00).  Thereafter, the amounts may be adjusted by the City of Cleveland on an annual basis, beginning July 1, 2025 and each year thereafter in proportion to the Consumer Price Index for Northeast Ohio, as published by the Bureau of Labor Statistics, U.S. Department of Labor.

Sec. 3106.07 Fees

(a)    The annual registration fee required shall be:

(1) For residential structures with no more than three (3) residential units, seventy dollars ($70.00) per unit.

(2) For all other structures, one thousand dollars ($1,000.00) per structure.

Seminole County, Fla. has amended its property registration ordinance to require registration within 10 days of foreclosure filing.  The program will require annual registration accompanied by a $200.00 fee.

ARTICLE III. - REGISTRATION AND MAINTENANCE OF FORECLOSED PROPERTIES

SEC. 95.25. - Registration of foreclosed real property.

(a)    Any mortgagee who holds a mortgage on real property located within unincorporated Seminole County shall perform an inspection of the property that is the security of the mortgage upon default of the mortgagor, at the time of the issuance of a Notice of Default.  If the property is found to be vacant or shows evidence of vacancy, it shall be deemed to be abandoned real property and the mortgagee shall, within ten (10) days of the inspection, register the property with the County or authorized agent on forms provided by the County.  A separate registration is required for each abandoned real property.

(e)    An annual registration fee, as established by Resolution of the Board of County Commissioners, shall accompany each registration form for each abandoned real property.  All registrations shall be valid for one (1) calendar year from the date of issuance.  Subsequent annual registrations and fees are due on or before the expiration of the previous registration.  Any part of the registration process may be performed for the County by an agent or independent contractor pursuant to the agreement on contract.

The township of Lower Makefield, Pa. has amended its property registration ordinance to reflect a semi-annual fee of $300.00.  The program will continue to require semi-annual registration within 10 days of foreclosure filing.

AN ORDINANCE OF THE TOWNSHIP OF LOWER MAKEFIELD, BUCKS COUNTY, PENNSYLVANIA, REPEALING CHAPTER 152, ARTICLE II, REGISTRATION OF VACANT PROPERTIES, OF THE CODE OF THE TOWNSHIP OF LOWER MAKEFIELD and REPLACING THE REPEALED CHAPTER WITH A NEW CHAPTER TO BE ENTITLED, "REGISTRATION OF FORECLOSURE MORTGAGES AND VACANT PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORIDNANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES AND VACANT PROPERTY BY OWNERS; PROVIDING FOR PENALTIES AND ENFORCEMENT, AND THE REGULATION, LIMITIATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE TOWNSHIP OF LOWER MAKEFIELD, TO REPEAL INCONSISTENT PROVISIONS, AND TO ESTABLISH SEVERABILITY AND EFFECTIVE DATE

II.    ARTICLE II REGISTRATION OF VACANT PROPERTIES

SECTION 152-14    INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE

(c)  Within ten (10) days of the date any Mortgagee institutes a Foreclosure Action, the Mortgagee shall register the Real Property with the Township Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action.  Separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.

(e)  At the time of initial registration each registrant shall pay a non-refundable Semi-Annual registration fee in the amount established by Resolution of the Board of Supervisors for each property.  Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount established by the Resolution of the Board of Supervisors are due within ten (10) days of the expiration of the previous registration.  Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted properties, (3) post-closing counseling and Foreclosure intervention limited to Owner-occupied persons in Default, which may not include cash and mortgage modification assistance, and (4) for any related purposes as may be adopted in the policy set forth in this Chapter.  Said fees shall be deposited to a special account in the Township's Department dedicated to the cost of implementation and enforcement of this Ordinance, and fulfilling the purpose and intent of this Chapter.  None of the funds provided for in this section shall be utilized for the legal defense of Foreclosure Actions.
