Jamesburg, NJ

The borough of Jamesburg, N.J. has amended its property registration ordinance to reflect an annual renewal requirement.  Properties must be registered within 30 days of vacancy and will reflect the following escalating fee structure:

Initial Registration: $250
1st Renewal: $250/500
2nd Renewal: $250/750
Subsequent Renewal (each year): $250/750

Chapter 19 Vacant Property

Sec. 19-2 REGISTRATION.

a.  Effective immediately, the owner of any vacant property as defined herein shall, within 30 calendar days after the building becomes vacant property or within 30 calendar days after assuming ownership of the vacant property, whichever is later, or within 10 calendar days of receipt of notice by the municipality, file a registration statement for such vacant property with the municipal officer on forms provided by the Borough for such purposes.  Failure to receive notice by the municipality shall not constitute grounds for failing to register the property.

VACANT/ABANDONED PROPERTY REGISTRATION

(REGISTRATION, RENEWAL FEE, & OPY OF VALID INSURANCE MUST ACCOMPANY THE REGISTRATION FORM)

Registration shall remain valid for 1 year from the date of registration.  The owner shall be required to renew the registration annually as long as the building remains a vacant and/or abandoned property and shall pay a registration or renewal fee in the amount prescribed in Borough Ordinance # 04-22 for each vacant property registered.  The initial registration fee for each building shall be $250.00.  The fee for the first renewal is $250/500 and the fee for the second renewal is $250/750.  The fee for any subsequent renewal beyond the second renewal is $250/750.

Bound Brook, NJ

The borough of Bound Brook, N.J. has amended its property registration requirement to reflect an annual fee of $500.00 for foreclosing properties and a semi-annual escalating fee structure for vacant properties (See below).  Properties must be registered within 14 days of vacancy or within 10 days of foreclosure filing.

a.  All owners of vacant property must register such vacant property with the Bound Brook Borough Clerk within 14 days of such property becoming vacant.  The registration must be renewed every six months as set forth below for as long as the property remains vacant.  Vacant property registration and fee progression schedule runs continuously from when the property is vacant through occupancy of said property.

a.  A creditor serving a summons and complaint in an action to foreclose on a mortgage on property in this Borough, including, but not limited to, residential property, shall, within 10 days of serving the summons and complaint, file a registration with the Bound Brook Borough Clerk.  The registration must be renewed as set forth below until title to the property has been transferred to a new owner or the foreclosure action is dismissed.  A creditor who takes title to a vacant property shall then be required to register as an owner of such vacant property and to renew such registration for as long as the property remains vacant.

Crafton, PA

The borough of Crafton, Pa. has enacted a property registration requirement within 30 days of vacancy.  The program will not require a registration fee.

Sec. 167-3 Vacant building registration.

B.  The record owner of a property shall register with the Code Enforcement Officer any vacant property in the borough within 30 days of such property becoming vacant or within 10 days of being notified by mail by the Code Enforcement Officer that a property is vacant as found through the Code Enforcement Officer's normal inspection process, and annually thereafter by July 15, for each subsequent calendar year, if such building or structure continues to be a vacant building or structure during each subsequent calendar year, until such time as such building or structure ceases to be a vacant building or structure.

Mayfield Heights, OH

The city of Mayfield Heights, Ohio has enacted a property registration requirement within 30 days of vacancy.  The program will require a $200.00 annual registration fee.

AN ORDINANCE ENACTING SECTION 1342 OF THE CODIFIED ORDINANCES OF THE CITY TITLED "VACANT PROPERTY/BUILDING REGISTRATION", AND DECLARING AN EMERGENCY

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MAYFIELD HEIGHTS, CUYAHOGA COUNTY, STATE OF OHIO, THAT:

SECTION 1.  Section 1342 of the Codified Ordinances of the city titled "VACANT PROPERTY/BUILDING REGISTRATION" is hereby enacted to read as follows:

1342.03   VACANT BUILDING REGISTRATION

(a)  Any building presently located within the City which is a vacant building shall be registered by the owner thereof with the Building Director not later than 30 days after it becomes a vacant building, or not later than 10 days of being notified of such vacancy by the Building Director, whichever occurs first.

1342.04  VACANT BUILDING REGISTRATION FEES

(a)  The owner of a vacant residential building shall pay an anual fee of two hundred dollars ($200.00) per building.  Renewal of the fee shall be due one year from the original filing date.

Independence Township, NJ

The township of Independence Township, N.J. has amended its property registration requirement to reflect both vacant and abandoned and foreclosure properties.  Annual registration is required within 10 days of foreclosure filing or vacancy with a fee of $500.00 for occupied properties in foreclosure and $2500.00 for vacant properties.

AMENDING CHAPTER 380 OF THE CODE OF THE TOWNSHIP OF INDEPENDENCE ENTITLED "VACANT AND ABANDONED STRUCTURES" REGARDING THE REGISTRATION OF VACANT AND FORECLOSED PROPERTIES TO BE CONSISTENT WITH P.L. 2021, C. 444

Sec. 380-4. Registration of Property.

a)  Any creditor who holds a mortgage or equity lien on real property located within the Township shall perform an inspection of the property to determine vacancy or occupancy, upon the commencement of foreclosure as evidenced by a foreclosure filing.  The creditor shall, within ten (10) days of the inspection, register the property with the Township Code Enforcement Official, or its designee, on forms or website access provided by the Township, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

d)  A non-refundable annual registration fee in the amount of $500.00 per property, shall accompany the registration form or website registration.  On each anniversary date of the initial registration, the creditor shall submit a renewal registration and fee as follows: 1) $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor; and (2) an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in the ordinance when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.

Altoona, PA

The city of Altoona, Pa. has amended its property registration requirement to reflect an annual fee of $200.00.  Properties must be registered within 45 days of vacancy or within 10 days of foreclosure filing.

Chapter 560 Registration of Properties in Default of Mortgage

Sec. 560-5 Registration requirements of abandoned real property.

A.  Any mortgagee who holds a mortgage on real property located within the City shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor.  The mortgagee shall, within 10 days of the inspection, register the property with the Department of Code Enforcement (DCE), or designee, on forms or website access provided by the City, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

Sec. 560-15  Fees.

A nonrefundable registration fee in the amount established by resolution of City Council from time to time shall accompany the registration form.

Chapter 563 Registration of Vacant Buildings

Article I Vacant Building Registry

Sec. 563-2. Applicability.

The requirements of this chapter shall be applicable to each owner of any building that is not a dwelling that shall have been vacant for more than 45 consecutive days and to each owner of residential property consisting of one or more vacant dwellings that shall have been vacant for more than 45 consecutive days.  Registration shall be required for all vacant building, whether vacant and secure, vacant and open, or vacant and boarded, and shall be required whenever any building has remained vacant for 45 consecutive days or more. 

Sec, 563-3. Registration statement; local agent and registration; fee schedule.

A.  Registration statement.  Each such owner shall cause to be filed a notarized registration statement, which shall include the street address and parcel number of each such vacant building, the names and addresses of all owners, as hereinafter described, and any other pertinent information deemed necessary by the Department.  The registration fee(s) as required by Sec. 563-3C of this chapter shall be billed by the Department and shall be paid by January 1 of each year.

Toms River, NJ

The township of Toms River, N.J. has amended its property registration requirement to reflect an annual fee of $500.00 for occupied properties and $2500.00 for vacant properties.  Registration is required with notification of a foreclosure filing.

Sec. 473-7.  Property registration program.

B.  A creditor filing a summons and complaint in an action to foreclose shall, in additional to the notices provided to the Township pursuant to N.J.S.A. 46:10B-51; P.L. 2021, c. 444, Sec. 2; and Article I of this chapter, must also register the residential or commercial property with the Division of Code Enforcement as a property in foreclosure.

Sec. 473-8.  Property registration fees.

A. Creditors required to register properties pursuant to this chapter are subject to the following fees:

(1) A fee of $500 per property annually for any property required to be registered because a summons and complaint have been filed in an action by the creditor to foreclose.

(2) An additional fee of $2000 per property annually if the property is vacant and abandoned, as defined pursuant to P.L. 2021, c. 444, Sec.2a(8); and Sec. 473-6, when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned at any time thereafter while the property is in foreclosure.
