Pompton Lakes, NJ

The borough of Pompton Lakes, NJ has amended its property registration requirement to an annual renewal.  Properties must be registered within 10 days of foreclosure filing and require a $500.00 annual registration fee.

AN ORDINANCE, AMENDING CHAPTER 22 OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF POMPTON LAKES ENTITLED "REGISTRATION OF FORECLOSING MORTGAGED PROPERTY AND VACANT PROPERTY"

SEC. 22-5.  INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE.

(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the Borough Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to  inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action when legally possible.  A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.

(f) At the time of initial registration each registrant shall pay a non-refundable Annual Registration fee of five hundred dollars ($500.00) for each property.  Subsequent nonrefundable Annual renewal registrations of properties and fees in the amount of five hundred dollars ($500.00) are due within ten (10) days of the expirations of the previous registration.

Somers Point, NJ

The city of Somers Point, N.J. has amended its property registration requirement by removing a pre-filing requirement and assessing late fees to annual registrations.  Properties must be registered within 10 days of foreclosure filing and are subject to a $500.00 annual registration fee.  If the registration fee is not paid within 30 days of when a registration or renewal is required, a late fee of 10% of the annual fee will be charged for every 30 day period the property is not registered.

An Ordinance Amending Chapter 169 Article VII, Mortgagee Registration Requiring the Registration and Maintenance of Certain Real Property by Mortgagees, Providing for Penalties and Enforcement, as well as the Regulation, Limitation and Reduction of Abandoned Real Property within the city of Somers Point, County of Atlantic; and Providing for Severability, Repealer, Codification, and an effective Date.

CHAPTER 169 ARTICLE VII. MORTGAGE REGISTRATION

Sec.169-74 Registration of foreclosure properties; duty to provide written notice.

A. Registration of real property by Mortgagee:

(3) The registration must be received within 10 days of the initiation of the foreclosure process as required by N.J.S.A. 46:10B51.

E. Annual registration.

(1)  All property registrations are valid for one year from the date the property was required to have been registered.

(a) The initial registration fee is $500 and must accompany the registration form.

(b) Subsequent annual registration fees are $500 and must accompany the registration form.

(c) All applications and fees are due by the registration date specified in Code Sec. 169-74.  All renewal applications and fees are due on the expiration of the prior annual registration.  Registration fees and renewal fees will not be prorated or refunded and are in addition to any fines, penalties or assessments which may be imposed under Code Sec. 169-79, including penalties for late registration.

(d) If the Foreclosure Property is not registered, or the registration fee is not paid within thirty (30) days of when the registration or renewal is required pursuant to this section, a late fee equivalent to the percent (10%) of the Annual Registration fee shall be charged for every thirty-day period (30), or portion thereof, the property is not registered and shall be due and payable with the registration.

Lower Paxton Township, PA

The township of Lower Paxton Township, Pa. has amended its property registration requirement by enacting a semi-annual escalating fee schedule (see below) and assessing late fees for past due payments.  Properties must be registered within 30 days of vacancy.  Properties in foreclosure must be registered within 10 days of foreclosure filing and are subject to a semiannual $300 registration fee.

Initial Registration: $300
1st Renewal: $600
2nd and subsequent renewals: $1200

REGISTRATION OF DEFAULTED MORTGAGE AND VACANT PROPERTY

Sec. 152-5. Registration of defaulted mortgage real property.

A.  Any mortgagee who holds a mortgage on real property located within Lower Paxton Township shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgage.  The mortgagee shall, within 10 days of the inspection, register the property with the Code Enforcement Department, or its designee, on forms or other manner as directed, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

H.  A nonrefundable semiannual registration fee of $300 shall accompany each registration pursuant to this section.

I.  If the registrable property is not registered, or the registration fee is not paid within 30 days of when the registration or renewal is required pursuant to this section, a late fee equivalent to 10% of the semiannual registration fee shall be charged for every thirty-day period, or portion thereof, the property is not registered and shall be due and payable with the registration.

Sec. 152-6.  Inspection and registration of real property not subject to mortgage in foreclosure.

A.  Any owner of vacant property located within the Township shall, within 30 days after the property becomes vacant, register the real property with the Township registry.

C.  At the time of initial semiannual registration, each registrant shall pay a nonrefundable registration fee of $300 for each vacant property.  Subsequent nonrefundable semiannual renewal registrations of vacant properties are due within 10 days of the expiration of the previous registration with fees increasing as follows: 1st renewal (6-12 months) $600; 2nd renewal (12-18 months) $1200; renewals after 18 months $1200.

E.  If the vacant property is not registered, or either the registration fee or the semiannual registration fee is not paid within 30 days of when the registration or semiannual registration is required pursuant to this section, a late fee equivalent to 10% of the semiannual registration fee shall be charged for every thirty-day period, or portion thereof, the property is not registered and shall be due and payable with the registration.

Hardyston Township, NJ

The township of Hardyston Township, N.J. has amended its property registration requirement to reflect properties that are both vacant or in foreclosure.  Properties must be registered within 90 days of vacancy or 10 days of foreclosure filing, and are subject to the following escalating fee schedule:

Initial Registration: $500
1st Renewal: $1500.00
2nd Renewal: $3000.00
3rd and Subsequent Renewals: $5000.00

AN ORDINANCE OF THE TOWNSHIP OF HARDYSTON, COUNTY OF SUSSEX, STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING CHAPTER 51, ABANDONED PROEPRTIES, ARTICLE I, VACANT RESIDENTIAL AND NONRESIDENTIAL PROPETIES, AND ARTICLE II, BUILDING PENDING FORECLOSURE OF THE REVISED GENERAL ORDINANCES

ARTICLE I Vacant Residential and Non-Residential Premises

Sec. 51-3 Certificate of Registration for Vacant and Abandoned Property

(a)  The Responsible Party for a vacant and abandoned property shall file a certificate of registration with the Clerk of the Township within 90 days after the property becomes vacant and abandoned or within 30 days after the Responsible Party assumes ownership of or responsibility for an already vacant and abandoned property, whichever is later.

(e)  An annual fee pursuant to Sec. 51-4, Fee Schedule, for a certificate of registration for a vacant and abandoned property shall be paid to the Clerk.

Sec. 51-4 Fee Schedule

The initial registration fee for each vacant and abandoned property under the provisions of this article shall be $500.  The fee for the first annual renewal shall be $1,500, and the fee for the second annual renewal shall be $3,000.  The fee for any subsequent annual renewal beyond the second renewal shall be $5,000.

ARTICLE II Buildings Pending Foreclosures

Sec. 51-10 Residential or Commercial Foreclosures

A.  The Creditor filing a summons and complaint in an action to foreclose shall, in additional to the notice provided to the municipality pursuant to N.J.S.A. 47:10B-51 register the residential or commercial property with the Township's Property Registration Program as a property in foreclosure.

F.  Fees.  The Creditor will pay an annual registration fee of: 

(1) $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the Creditor.

(2) An additional fee is to be imposed as per Chapter 51, Abandoned Properties, Section 51-4, Fee Schedule per property annually if the property is vacant or abandoned when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.

Lindenwold, NJ

The borough of Lindenwold, N.J. has amended its property registration requirement to require registration of properties in foreclosure or vacant and abandoned.  Properties must be registered annually with a fee of $500 for occupied properties in foreclosure, and an additional $2,000 if the property is vacant or abandoned.

Sec. 238-26 Registration required.

Any creditor filing a summons and complaint in an action to foreclose shall, in addition to the notice provided to the municipality pursuant to Section 17 of P.L. 2008, c. 127 (N.J.S.A. 46:10b-51) or Section 2 of P.L. 2021, c. 444 (N.J.S.A. 40:48-2.12s2), register the residential or commercial property with the Borough of Lindenwold's property registration program as a property in foreclosure and, as part of that registration:

C. Identify whether the property is vacant and abandoned in accordance with the definition in this article set forth in Sec. 238-32.

Sec. 238-34 Annual fee.

An annual fee shall be imposed as listed in Chapter 150, Article I, Sec. 150-49 upon a creditor required to register a property pursuant to this article in the amount of 1) $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor; and 2) an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition as set forth in Sec. 238-32 of this article when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in Sec. 238-32 at any time thereafter while the property is in foreclosure.  The annual fee shall be initially due and payable within 30 days of registering the property pursuant to Sec. 238-26 of this article, and shall be due and payable on the anniversary date of the initial registration thereafter, for each succeeding year.

The township of Sparta, N.J. has amended its property registration requirement to reflect properties that are both vacant and in foreclosure.  Properties must be registered within 90 days of vacancy and are subject to a fee of $500.00 for occupied properties in foreclosure, and an additional $2000.00 if the property is vacant or abandoned.
