The borough of Lawnside, N.J. has amended its property registration requirement from bi-annual to annual renewal with a registration fee of $500.00. The amendment also states that properties must be registered within 10 days of foreclosure filing. The requirement was previously within 30 days of foreclosure filing.

ORDINANCE NO. 10-2022

AMENDING THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES, PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE BOROUGH OF LAWNSIDE.

B.  ANNUAL REGISTRATION - shall mean 12 months from the date of the first action that requires registration, as determined by the Borough of Lawnside, or its designee, and every subsequent 12 months.

B.  The Mortgagee filing a summons and complaint in an action to foreclose in the Borough of Lawnside shall, within (10) days of the inspection, register, the property with the Code Enforcement Department, or its designee, on forms or other manner as directed, and indicate whether the property is vacant or occupied.

J.  A non-refundable registration fee of $500.00 shall accompany each registration pursuant to this section.

Haddon Heights, NJ

The borough of Haddon Heights, N.J. has amended its property registration requirement from bi-annual to annual renewal. Fees have also been amended to reflect a $500.00 annual registration fee for occupied properties and a $2000.00 annual registration fee for vacant properties.

AN ORDINANCE AMENDING CODE OF THE BOROUGH OF HADDON HEIGHTS TO BE ENTITLED, 'VACANT AND ABANDONED PROPERTIES: NOTICE, REGISTRATION AND FEES," PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES; PROVIDING FOR PENALTIES AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE BOROUGH; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.

4. REGISTRATION, NOTICE AND OTHER CREDITOR REQUIREMENTS

(c) Creditors of any commercial and/or residential mortgage required to notify the Borough pursuant to this section shall:

(1) Register the property with the Borough's property registration program as a property in foreclosure.

(2) Be subject to the registration fee, notice requirements and penalties for non-compliance established within this Article; 

5. FEES, VIOLATIONS AND PENALTIES

(b) Creditors required to notify the Borough and register a property as one in foreclosure shall be required to pay the following annual registration fee, per property, due at the time of the registration of $500.00.

(c) If a property registered with the Borough's registration program as a property in foreclosure is vacant and abandoned at the time of the registration, or becomes vacant and abandoned at any time during the pendency of the foreclosure proceeding, the creditor shall pay an additional annual registration fee, per property, due at the time the determination that the property is vacant and abandoned is made, of $2000.00.

Hamilton, NJ

The township of Hamilton, N.J. has amended its property registration requirement from bi-annual to annual renewal. Fees have also been amended to reflect a $500.00 annual registration fee for occupied properties and a $2500.00 annual registration fee for vacant properties.

ORDINANCE NO.:1999-2022

AN ORDINANCE AMENDING ARTICLE II. SEC. 238-10 THROUGH AND INCLUDING SEC. 238-10 TO SEC. 238-17 - REGISTRATION OF PROPERTIES IN FORECLOSURE

REGISTRABLE PROPERTY

Any real property located in the Township, whether vacant or abandoned or occupied, that is subject to a foreclosure as defined in this article.

ANNUAL REGISTRATION

The registration of a registrable property twelve months from the date of the first action that requires registration by the terms of this article and every subsequent twelve months.  The date of the initial registration may be different than the date of the first action that required registration.

Sec. 238-14

Registration of registrable property.

A. The mortgagee of registrable property shall, within 10 days from the commencement of foreclosure, register the property with the Division of Code Enforcement, or other Township designee, on paper forms or by electronic means provided by the Township.  The mortgagee shall indicate whether the property is vacant or abandoned or occupied.

C. Mortgagees of property that is registrable property on the effective date of this article shall, within 30 days from the effective date, register the property with Division of Code Enforcement, or other Township designee, on paper forms or by electronic means provided by the Township.

E. A nonrefundable annual registration fee of $500 shall accompany each registration pursuant to this section; and an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in the ordinance when the summons and complaint in an action to foreclosure is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.
