The city of Long Beach, N.Y. has amended its property registration ordinance to reflect an increased fee of $1000.00 (previously $500.00).  The change became effective on November 15, 2022.  The requirement remains that the property must be registered within 10 days of default.

ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE CITY OF LONG BEACH RE: HOUSING AND PROPERTY REHABILITATION AND CONSERVATION CODE: MORTGAGE-IN-DEFAULT REGISTRY.

Sec.1. Chapter 13, Article II, Section 13-29 of the Code of Ordinances of the City of Long Beach, as heretofore amended, shall be and the same is hereby added to said Chapter and amended to read as follows:

"Sec. 13-29. Mortgage-in-Default Registry

(d)  Registration of real property with mortgage-in-default.

2.  Within ten (10) days of the date that the mortgagee declares its mortgage on a particular parcel of real property to be in default, the mortgagee shall inspect and register the real property with the City's mortgage-in-default registry.  The mortgagee shall include in the registration if the property is vacant or occupied.

ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE CITY OF LONG BEACH RE: HOUSING AND PROPERTY REHABILITATION AND CONSERVATION CODE: MORTGAGE-IN-DEFAULT REGISTRY.

Sec.1. Chapter 13, Article II, Section 13-29 (d)(4) of the Code of Ordinances of the City of Long Beach, shall be and the same is hereby amended to read as follows:

"Sec. 13-29.  Mortgage-in-Default Registry.

(d)  Registration of real property with mortgage-in-default.

(4)  An annual non-refundable registration fee in the amount of $1000 per property shall accompany the mortgage-in-default registration form(s).  Subsequent annual registrations of defaulted properties and fees in the amount of $1000 are due within ten (10) days of the expiration of the previous registration."

Franklin Township (Hunterdon County), NJ

The township of Franklin Township in Hunterdon County, N.J. had enacted a property registration ordinance within 10 days of foreclosure filing or within 10 days of vacancy.  The program will require annual fees of $500.00 for occupied properties and $2500.00 for vacant properties.

FRANKLIN TOWNSHIP

HUNTERDON COUNTY, NEW JERSEY

ORDINANCE OF THE TOWNSHIP OF FRANKLIN, COUNTY OF HUNTERDON, STATE OF NEW JERSEY, DELETING IN ITS ENTIRETY CHAPTER 268 ENTITLED "RESIDENTIAL MAINTENANCE", AND REPLACING SAME WITH CHAPTER 346 ENTITLED "VACANT PROPERTY MAINTENANCE" TO BE CONSISTENT WITH P.L. 2021, C. 444

Sec. 346.4.  Registration of Property.

a)  Any creditor who holds a mortgage or equity lien on real property located within the Township shall perform an inspection of the property to determine vacancy or occupancy, upon the commencement of foreclosure as evidenced by a foreclosure filing.  The creditor shall, within ten (10) day of the inspection, register the property with the Township Code Enforcement Official, or its designee, on forms or website access provided by the Township, and indicate whether the Property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

d)  A non-refundable annual registration fee in the amount of five-hundred dollars ($500.00) per property shall accompany the registration form or website registration.  On each anniversary date of the initial registration, the creditor shall submit a renewal registration fee as follows: 1) five hundred dollars ($500.00) per property annually for any property that is required to be registered because a summons and a complaint in an action to foreclose was filed by the creditor; and 2) an additional two thousand dollars ($2000.00) per property annually if the property is vacant and abandoned pursuant to the definition in the ordinance when the summons and the complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.

Bordentown, NJ

The township of Bordentown, N.J. has amended its property registration ordinance to reflect that properties be registered within 10 days of foreclosure filing or within 30 days of vacancy.  Previously, only vacant properties required registration.  The program requires an annual fee of $500.00 for occupied properties and $2000.00 for vacant properties.

ORDINANCE No. 2022-16

ORDINANCE REPLACING CHAPTER 8.29 OF THE BORDENTOWN TOWNSHIP MUNICIPAL CODE ENTITLED "MAINTENANCE OF VACANT, ABANDONED AND FORELOSURE PROPERTIES" WITH CHAPTER 8.29 ENTITLED "REGISTRATION AND MAINTENANCE OF VACANT, ABANDONED, AND PROPERTIES SUBJECT TO FORELOSURE PROCEEDINGS"

Section 1. Section 8.29 of the Bordentown Township Municipal Code entitled "Maintenance of Vacant, Abandoned, and Foreclosure Properties" is hereby replaced in its entirety as follows:

"Registration and Maintenance of Vacant, Abandoned, and Properties Subject to Foreclosure Proceedings"

8.29.020 Notice of summons and complaint in an action to foreclose; Creditor responsibility.

A.  Any creditor serving a summons and complaint in an action to foreclose on a mortgage on commercial or residential property within the Township of Bordentown shall, within 10 days of serving the summons and complaint, notify the Township Clerk, Township Administrator, and Director of Community Development, in accordance with this Chapter.

8.29.070 Annual Registration Fees.

A.  Any creditor filing a summons and complaint in an action to foreclose shall, in addition to the notice provided to the municipality pursuant to section 17 of P.L. 2008, c. 127 (C.46:10B-51) or section 2 of P.L. 2021, c. 444 (C.40:48-2.12s2), shall pay an annual registration fee in the amount of $500.  An additional registration fee in the amount of $1,500 shall be paid by the creditor if such property shall become vacant or abandoned pursuant to the definition in this ordinance when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in this ordinance at any time thereafter while the property is in foreclosure.

Guttenberg, NJ

The town of Guttenberg, N.J. has amended its property registration ordinance to reflect an annual renewal requirement (previously semi-annual).  Properties must be registered within 10 days of foreclosure filing and are subject to a $500.00 annual registration fee.

ORDINANCE AMENDING CHAPTER XIII, SECTION 13-8 OF THE REVISED GENERAL ORDINANCES OF THE TOWN OF GUTTENBERG ENTITLED "REGISTRATION OF DEFAULTED MORTGAGE PROPERTY"

REGISTRATION OF VACANT, ABANDONED AND FORECLOSED PROPERTIES

SECTION 8 - 5.  REGISTRATION OF DEFAULTED MORTGAGE REAL PROPERTY

B.  The Mortgagee shall, within ten (10) days of the inspection, register the property with the Code Enforcement Department, or its designee, on forms or other manner as directed, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

C.  Registration pursuant to this section shall contain the name, direct mailing address, a direct contact name, telephone number, mailing address and email address for the Mortgagee/Trustee, and the Mortgage Servicer, and the name and twenty-four (24) hour contact phone number of the local property management company responsible for the security and maintenance of the property who has the authority to make decisions concerning the abatement of nuisance conditions at the property, as well as any expenditure in connection therewith.

Each individual property on the Registry that has been registered for six (6) months or more prior to the Effective Date shall have thirty (30) days to renew the registration and pay the non-refundable $500.00 annual registration fee.  Properties registered less than six (6) months prior to the Effective Date shall renew the registration upon expiration and every twelve (12) months thereafter and shall pay the non-refundable $500.00 annual registration fee.
