Braddock, PA

The borough of Braddock, Pa., has enacted property registration requirements upon 30 days of vacancy. The program will be enforced through a third-party service provider (MuniReg) and will include a $200 registration fee.

Section 3. Definitions.

Abandoned

A building or structure that is unoccupied for more than thirty (30) days and is, or has been, the subject of: (i) a mortgage foreclosure action or notice; (ii) a bankruptcy sale or notice; (iii) a delinquent tax sale or notice; or (iv) a mortgage foreclosure action where the title to property has been retained by the beneficiary of a deed of trust involved in the foreclosure or transferred under a deed in lieu of foreclosure/sale. For the purposes of this definition, the term “notice” shall mean the legal notice provided to a party in conjunction with a properly filed legal action.

Section 6. Registration of Abandoned and/or Vacant Real Property.

A.  If any property is found to be vacant or abandoned, pursuant to the definitions of this        Ordinance, or shows evidence of vacancy, then the owner shall register the property with the Borough of Braddock Code Enforcement Office, or such other entity as designated by the Borough of Braddock, on a form or forms provided by the Borough.

C. Properties subject to registration under this Ordinance shall remain under the annual registration requirement, security and maintenance standards of this Ordinance for so long as they remain vacant or abandoned.

Section 12. Fees and Penalties.

A. nonrefundable registration fee in the amount of Two Hundred Dollars ($200.00) per property shall accompany the initial registration form.

Anniston, AL

The city of Anniston, Ala., has enacted property registration requirements within 15 days of vacancy and/or 7 days from the first public foreclosure action. The program will be enforced by a third-party service provider (MuniReg) and will include a $200 annual fee.

ARTICLE VI – REGISTRATION OF VACANT PROPERTIES

Sec. 34.44. – Registration.

       (1)  Upon knowledge of a Commercial or Industrial or Residential Property being vacant, the Owner and/or Creditor shall within 15 days register the property as a vacant property with the Building and Safety Division of the City of Anniston.
       (2)  Upon initiating the legal process to foreclose real property, but no later than upon filing a complaint of foreclosure, or upon executing a deed in lieu of foreclosure on a commercial or Industrial Building or Residential Property, and a registration as prescribed in Subsection1, above, has not yet been completed, the Creditor shall within 7 days register the property as a property in foreclosure with the building and Safety Division of the City of Anniston.

Sec. 34.47 – Administrative Fees.

       (2)  Any Owner or Creditor of a Residential Property required to be registered by this Article shall pay to the City a registration fee in the amount of Two Hundred Dollars ($200.00) per year.

Cherry Valley, NY

The town of Cherry Valley, N.Y., has enacted property registration requirements to within 10 days of the first foreclosure action or within 30 days of vacancy. The program will be enforced by a third-party service provider (ProChamps) and will include a $250 semi-annual fee.

Sec. 2. Definitions

Semi-Annual Registration

Six (6) months from the date of the first action that requires registration, as determined by the Village, or its designee, and every subsequent six (6) months. The date of the initial registration may be different than the date of the first action that required registration.

Sec. 5. Registration of Vacant Real Property

A. Any owner of any vacant structure located within the Village shall, within thirty (30) days of the structure becoming vacant, register said structure with the Enforcement Officer, or his/her designee, on forms or in such other manner as directed. A separate registration is required for each vacant structure.

C. Owners who have existing registrable property on the effective date of this local law have thirty (30) calendar days from the effective date to register the property with the Enforcement Officer, or his/her designee, on forms or in such other manner as directed. A separate registration is required for each registrable property.

Sec. 6. Inspection and registration of Real Property Under Foreclosure

C. Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the Village Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action when legally possible. A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.

Fleetwood, PA

The borough of Fleetwood, Pa., has amended its property registration requirements by partnering with third-party service provider MuniReg. The ordinance will continue to require that properties be registered after 90 days of vacancy or upon filing of first legal action, as well as a $200 annual fee.

Section 5 - REGISTRATION

Registration is required of the following properties:

  1. Any property in default of the mortgage, for the period of time the mortgage remains in default.
  2. Any property subject to foreclosure sale.
  3. This section shall also apply to property which is currently unoccupied and remains unoccupied for a period in excess of 90 consecutive days.
