AN ORDINANCE, CREATING ARTICLE 1726 of TITLE 17, OF THE CODIFIED ORDINANCES OF THE CITY OF TITUSVILLE, PENNSYLVANIA, TO BE ENTITLED, "REGISTRATION OF FORECLOSING MORTGAGE PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES; PROVIDING FOR PENALITIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE CITY; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
TITLE 17. ARTICLE 1726.
REGISTRATION OF FORECLOSING MORTGAGE PROPERTY
Section 1726.05. Inspection And Registration Of Real Property Under Foreclosure.
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the City Registry, and designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action. A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $300.00 for each property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of $300.00 are due within ten (10) days of the expiration of the previous registration.

Subsequent non-refundable Semi-Annual renewal registrations of properties and fees shall also be set by said Fee Schedule and are due within ten (10) days of the expiration of the previous registration.

The borough of Mountain Lakes, N.J. has enacted a property registration requirement within 10 days of foreclosure filing. The program will require semi-annual registration accompanied by a $500.00 fee.

Sec. 189-5. INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the Borough Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action when legally possible. A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of five hundred dollars ($500.00) for each property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of five hundred dollars ($500.00) are due within ten (10) days of the expiration of the previous registration.
The city of Oakland, Calif. has amended its property registration requirement to reflect an annual fee of $1,967.96. The program will continue to require annual registration within 30 days of notice of default.

AN ORDINANCE AMENDING AND RESTATING OAKLAND MUNICIPAL CODE CHAPTER 8.54 (THE FORECLOSED AND VACANT RESIDENTIAL BUILDING REGISTRATION PROGRAM) BY EXPANDING IT TO INCLUDE BOTH VACANT AND OCCUPIED RESIDENTIAL PROPERTY AND MULTIPLE UNIT BUILDINGS TO THE FORECLOSED AND DEFAULTED RESIDENTIAL PROPERTY REGISTRATION PROGRAM, TO SET OUT MORE SPECIFIC MAINTENANCE AND SECURITY REQUIREMENTS AND TO PROVIDE FOR ABATEMENT OF BLIGHT AND NUISANCES AT SUCH PROPERTIES
THE COUNCIL OF THE CITY OF OAKLAND DOES ORDAIN AS FOLLOWS:
Chapter 8.54 - FORECLOSED AND DEFAULTED RESIDENTIAL PROPERTY REGISTRATION and ABATEMENT PROGRAM
Article III. - Registration
8.54.200 - Properties Subject to Registration
A. Vacant and Occupied Residential Properties with a Recorded Notice of Default.
1. Within 30 days of recording a Notice of Default with the Alameda County Clerk-Recorder's Office, a Responsible Party or its designee shall perform an inspection of the property that is the security for the Deed of trust the Notice of Default is recorded against.
2. If the property is found to be Vacant or shows sufficient Evidence Of Vacancy that it is deemed to be Abandoned, by this Chapter or under the deed of trust, the Responsible Party shall, within 30 days of the inspection, register with the City and pay the required registration fee pursuant to O.M.C. 8.54.20. If the property is deemed Abandoned, the Beneficiary shall invoke an abandonment or any other appropriate provision express or implied in the Deed of Trust to permit the Beneficiary to assume possession or control of the Property sufficient to permit the Beneficiary or other Responsible Party to comply with the requirements of this Chapter.
8.54.230 Fees.
Fees for registration of all properties required to be registered pursuant to this Chapter are set out in the master fee schedule. In the case of hard copy registration under 8.54.220(A)(1), initial registration fee shall accompany the registration form. The City may provide for electronic payment of fees that are registered through the City's website. Otherwise, fees must be received by the City within 10 days of the date of registration. Fees shall be fully paid at the time of submitting the statement of registration to the City and annually thereafter on the anniversary date of submittal, unless a subsequent ordinance of the City Council to amend the master fee schedule otherwise specifies.

Foreclosed & Defaulted Residential Properties
Registration, Inspection & Maintenance Program
The City of Oakland's Foreclosed and Defaulted Residential Properties Registration, Inspection and Maintenance Program requires owners or the beneficiary and/or trustee pursuing property foreclosure and/or their agents to register, inspect, and potentially maintain their residential properties to protect the health and safety, livability, appearance and social fabric of our neighborhoods.
An annual registration fee of $1,967.96 is required, although this fee is waived for NOD (Notice of Default) occupied properties. However, when the NOD occupied property changes status to NOD vacant, then a registration fee will be required. Property status must be changed through the registry within 10 days.
