The township of Moore, Pa. has enacted a property registration requirement within 10 days of foreclosure filing.  The program will require semi-annual registration that will be accompanied by a $300.00 fee.Property Registration Ordinance

ORDINANCE 2024-06

AN ORDINANCE, CREATING CHAPTER 215, PROPERTY REGISTRY, ARTICLE I, OF THE CODE OF THE TOWNSHIP OF MOORE TO BE ENTITLED, "REGISTRATION OF FORECLOSING MORTGAGED PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGES; PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE TOWNSHIP; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.

CHAPTER 215.  PROPERTY REGISTRY.  ARTICLE I. REGISTRATION OF FORECLOSING MORTGAGED PROPERTY

Sec. 215.5 INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE

C.  Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the Township Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action, regardless of whether it is occupied or vacant.

E.  At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $300.00 for each property.  Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of $300.00 are due within ten (10) days of the expiration of the previous registration.

Knowlton Township, NJ

The township of Knowlton, N.J. has amended its property registration requirement to reflect an annual fee of $500.00 for occupied properties in foreclosure and $2,500.00 for vacant properties in foreclosure.  The program will continue to require annual registration within 10 days of foreclosure filing.

TOWNSHIP OF KNOWLTON

WARREN COUNTY, NEW JERSEY

ORDINANCE NO.2022-07

AMENDING CHAPTER 142 OF THE CODE OF THE TOWNSHIP OF KNOWLTON ENTITLED "PROPERTY, VACANT AND ABANDONED" REGARDING THE REGISTRATION OF VACANT AND FORECLOSED PROPERTIES TO BE CONSISTENT WITH P.L. 2021, C. 444

Sec, 142-4.  Registration of Property.

a)  Any creditor who holds a mortgage or equity lien on real property located within the Township shall perform an inspection of the property to determine vacancy or occupancy, upon the commencement of foreclosure as evidenced by a foreclosure filing.  The creditor shall, within ten (10) days of the inspection, register the property with the Township Code of Enforcement Official, or its designee, on forms or website access provided by the Borough, and indicate whether the property is vacant or occupied.  A separate registration is required for each property, whether it is found to be vacant or occupied.

d)  A non-refundable annual registration fee in the amount of $500.00 per property, shall accompany the registration form or website registration.  On each anniversary date of the initial registration, the creditor shall submit a renewal registration and fee as follows: 1) $500 per property annually for any property that is required to be registered because a summons and complaint in an action to foreclose was filed by the creditor; and (2) an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in the ordinance when the summons and complaint in an action to foreclose is filed, or becomes vacant and abandoned pursuant to the definition in the ordinance at any time thereafter while the property is in foreclosure.

Willingboro Township, NJ

The township of Willingboro, N.J. has amended its property registration requirement to reflect the following escalating fee schedule.  Registration will continue to be required annually after 30 days of vacancy.

Amended Fee Schedule:
Initial Registration: $500.00
First Renewal: $750.00
Second Renewal: $1,000.00
All Subsequent Renewals: $1,500.00

Article V  Registration of Vacant Properties

Sec. 272-42 Registration required.

[Amended 12-6-2022 by Ord. No. 2022-15]

A.  The owner/creditor of any vacant property, as defined herein, shall, within 60 days after the building becomes vacant property or within 30 days after assuming ownership of the vacant property, whichever is later, file a registration statement for each such vacant property with the Willingboro Township Inspections Department on forms provided by the department for such purposes.  The registration shall remain valid for one year from the date of registration.  The owner/creditor shall be required to renew the registration annually as long as the building remains vacant property and shall pay a registration fee in the amount prescribed under the fee schedule.

Sec. 272-44 Fee schedule.

A.  The initial registration fee for each building shall be $500.  The fee for the renewal is $750, and the fee for the second renewal is $1,000.  The fee for any subsequent renewal beyond the second renewal is $1,500.

Pittsgrove Township, NJ

The township of Pittsgrove, N.J. has amended its property registration ordinance to reflect an annual registration requirement within 10 days of foreclosure or 30 days of vacancy.  If the property is in foreclosure, the program will require an annual fee of $500.00 for occupied properties or $2,500.00 for vacant properties.  If the property is vacant and is not subject to a foreclosure filing, the program will require annual registration accompanied by the following escalating fee schedule:

Initial Registration: $500.00
First Renewal: $1,500.00
Second Renewal: $3,000.00
Third and Subsequent Renewals: $5,000.00

Chapter 73. Property Maintenance

Article II.  Maintenance of Vacant/Abandoned Properties

Sec. 73-10. Inspection and registration of defaulted mortgage.

C. Within 10 days of the date any mortgagee declares its mortgage to be in foreclosure, the mortgagee shall register the real property with the Township registry, and, at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain and secure the real property subject to the mortgage in default or defaulted.  A separate registration is required for each registrable property.

E.  Fees and fines.

(1)  At the time of initial registration, each registrant shall pay a nonrefundable annual registration fee of $500 for each registrable property.  Subsequent annual registrations of defaulted properties and fees in the amount of $500 are due within 10 days of the expiration of the previous registration.

(2)  Creditors shall be required to pay an additional $2,000 per property annually if the property is vacant or abandoned pursuant to the definition in this article when the summons and complaint in an action to foreclose is filed or becomes vacant and abandoned pursuant to the definition in this article at any time thereafter while the property is in foreclosure.

A.  Any owner of vacant property located within the Township shall, within 10 days after the property becomes vacant, or within 10 days after assuming ownership of the property, whichever is later, register the real property with the Township registry.

C.  At the time of initial registration, each registrant shall pay a nonrefundable annual registration fee of $500 for each vacant property.  The fee for the first subsequent annual registration of vacant property is $1,500.  The fee for the second subsequent annual registration of vacant property is $3,000.  The fee for any subsequent annual registration after the second renewal of vacant property is $5,000.  All annual registration fees are due within 10 days of the expiration of the previous registration.
