AN ORDINANCE TO ADOPT CHAPTER 1379 - VACANT PROPERTY REGISTRATION OF THE CODIFIED ORDINANCES OF THE CITY OF CONNEAUT, ATTACHED HERETO AND MARKED EXHIBIT "A".

VACANT PROPERTY REGISTRATION

1379.03 VACANT PROPERTY/BUILDING REGISTRATION.
(a) The owner shall register with the Planning and Zoning Department not later than ninety (90) days after any building located in an area zoned for, or abutting an area zoned for, residential or commercial use in the City becomes a vacant building or not later than thirty (30) days of being notified by the Planning and Zoning Department of the requirement to register based on evidence of vacancy, whichever event first occurs.
(j) The registration and all associated processes must be completed in its entirety annually for as long as the property remains vacant.
1379.06 VACANT BUILDING FEES.
The fees shall be reasonably related to the administrative costs for registering and processing the vacant building owner registration form and for the costs incurred by the City in monitoring the vacant building site. The annually increased fee amounts shall be reasonably relat4ed to the costs incurred by the City for demolition and hazard abatement of or repairs to vacant buildings, as well as the continued normal administrative costs stated above.
(a) The owner of a vacant residential building shall pay an annual fee in an amount to be established by ordinance and amended as deemed necessary as long as the building remains vacant. For every consecutive year that the building remains vacant, the annual fee will be assessed at double the previous year's fee amount for a maximum annual fee equaling the five (5) year fee in an amount to be established by ordinance and amended as deemed necessary to be used for the fifth and for all consecutive, subsequent years of vacancy.
(b) The owner of a vacant commercial building shall pay an annual fee in an amount to be established by ordinance and amended as deemed necessary as long as the building remains vacant. For every consecutive year that the building remains vacant, the annual fee will be assessed at double the previous year's fee amount for a maximum annual fee equaling the five (5) year fee in an amount to be established by ordinance and amended as deemed necessary to be used for the fifth and for all consecutive, subsequent years of vacancy.

AN ORDINANCE, OF THE TOWNSHIP OF MARPLE, DELAWARE COUNTY, PENNSYLVANIA BY ADDING A NEW CHAPTER 219 TO BE ENTITLED, "REGISTRATION OF FORECLOSING MORTGAGED PROPERTY"; PROVIDING FOR THE PURPOSE, INTENT AND APPLICABILITY OF THE ORIDNANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES; PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITH THE Township; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
SECTION 5. INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Registrable Property with the Township Registry, and, at the time of registration, indicate whether the Registrable Property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Registrable Property subject to the mortgage under a Foreclosure Action. A separate registration is required for each Real Property subject to a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $300.00 for each Registrable Property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of $300.00 are due within ten (10) days of the expiration of the previous registration. Said fees shall be used t6o offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted Real Properties, (3) post-closing counseling and Foreclosure intervention limited to Owner-occupied persons in Default, which may not include cash and mortgage modification assistance, and (4) for any related purposes as may be adopted in the policy set forth in this Chapter. Said fees shall be deposited to a special account in the Township's Department dedicated to the cost of implementation and enforcement of this Ordinance and fulfilling the purpose and intent of this Chapter. None of the funds provided for in this Section shall be utilized for legal defense of Foreclosure Actions.

The city of Newberry, Fla. has amended its property registration requirement to reflect a semi-annual fee of $350.00. The program will continue to require registration within 10 days of foreclosure filing or 10 days of vacancy.

AN ORDINANCE OF THE CITY OF NEWBERRY, FLORIDA, REPEALING CHAPTER 14, ARTICLE II, DIVISION 4, SECTION 14-135 AND CREATING CHAPTER 14, ARTICLE II, DIVISION 6, CITY OF NEWBERRY, FLORIDA, TO BE ENTITLED, "REIGSTRATION OF FORECLOSING MORTGAGES AND VACANT PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY ORTGAGEES AND VACANT PROPERTY OWNERS; PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE CITY OF NEWBERRY; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
Sec. 14-174 INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any mortgagee files a foreclosure action, the mortgagee shall register the real property with the City of Newberry registry, and, at the time of registration, indicate whether the property is vacant, and if so shall designate in writing a property manager to inspect, maintain, and secure the real property subject to the mortgage under a foreclosure action. A separate registration is required for each property under a foreclosure action, regardless of whether it is occupied or vacant.

Sec. 14-175 INSPECTION AND REGISTRATION OF REAL PROPERTY THAT IS NOT SUBJECT TO A MORTGAGE IN FORECLOSURE
(a) Any owner of vacant property, as defined in this chapter, located within the City of Newberry shall within ten (10) days after the property becomes vacant, register the real property with the City of Newberry Registry. Structures that are vacant property at the time of the adoption of this ordinance must register within fifteen (15) days of the date this ordinance takes effect.
(c) At the time of initial registration each registrant shall pay a non-refundable semi-annual registration fee of $350.00 for each vacant property. Subsequent non-refundable semi-annual renewal registrations of vacant properties and fees in the amount of $350.00 are due within ten (10) days of the expiration of the previous registration. Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to vacant properties, and (3) for any related purposes as may be adopted in the policy set forth in this Chapter. Said fees shall be deposited to a special account in the City of Newberry's Department dedicated to the cost of implementation and enforcement of this Ordinance, and fulfilling the purpose and intent of this Chapter.
The city of Markham, Ill. has amended its property registration ordinance to reflect a semi-annual registration requirement within 10 days of foreclosure filing or 30 days of vacancy. The program will continue to require a semi-annual registration fee of $500.00.

(C) Registration of real property under foreclosure.
(2) Real property within the city shall be registered under this division by the mortgagee within ten days of the mortgagee filing a foreclosure action.
(3) At the time of initial registration each registrant shall pay a non-refundable semi-annual registration fee of $500 for each registrable property. Subsequent non-refundable semi-annual registrations of properties and fees in the amount of $500 are due within ten days of the expiration of the previous registration. Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to defaulted properties, (3) post-closing counseling and foreclosure intervention limited to owner-occupied persons in default, which may not include cash and mortgage modification assistance, and (4) for any related purposes as may be adopted in the policy set forth in this chapter.
(D) Registration of all other vacant and abandoned properties.
(3) An owner of any vacant property shall, within 30 days after the property becomes vacant or within 30 days after notice that a building has been declared vacant, register the vacant property with the Building and Housing Department.
(5) At the time of initial registration each registrant shall pay a non-refundable semi-annual registration fee of $500 for each property. Subsequent non-refundable semi-annual registrations of properties and fees in the amount of $500 are due within ten days of the expiration of the previous registration. Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to vacant and abandoned properties, and (3) for any related purposes as may be adopted in the policy set forth in this section.
The city of New Philadelphia, Ohio has enacted a property registration requirement within 90 days of vacancy. The program will require annual registration accompanied by the following escalating fee structure:
Initial Registration: $150.00
1st Renewal: $300.00
2nd Renewal: $600.00
3rd Renewal: $1,200.00
4th and Subsequent Renewals: $2,400.00

Vacant Property Registration
1343.03 VACANT PROPERTY/BUILDING REGISTRATION.
(a) An owner of a structure which meets the definition of "vacant" residential, commercial, or industrial property as set forth in this chapter shall register such structure with the New Philadelphia Service Director or designee upon the earliest of the following events:
(1) Not later than ninety (90) days after it becomes vacant; or
(2) Not later than thirty (30) days of being notified by the New Philadelphia Service Director or designee of the requirement to register based on evidence of vacancy; or
(3) Not later than thirty (30) days of the issuance of an order to vacant by the New Philadelphia Service Director or designee under New Philadelphia Codified Ordinance Section 1355.07.
(i) The registration required by this Chapter shall be for the period January 1 through December 31 of each year and shall be renewed annually for as long as the residential, commercial, or industrial property remains subject to the registration requirement of this Chapter.
1343.05 VACANT BUILDING FEES.
The fees shall be reasonably related to the administrative costs for registering and
processing the vacant building owner registration form and for the costs incurred by the City in
monitoring the vacant building site. The annually increased fee amounts shall be reasonably
related to the costs incurred by the City for demolition and hazard abatement of or repairs to
vacant buildings, as well as the continued normal administrative costs stated above.
(a) The owner of a vacant residential building shall pay an annual fee of one
hundred fifty dollars ($150.00) for the first year the building remains vacant.
For every consecutive year that the building remains vacant, the annual fee will
be assessed at double the previous year's fee amount for a maximum annual fee
equaling the five (5)-year fee of two thousand four hundred dollars ($2,400.00)
to be used for the fifth and for all consecutive, subsequent years of vacancy.
The city of Pomona, Calif. has amended its property registration requirement to reflect an annual fee of $472.15. The program will continue to require annual registration within 10 days of vacancy.

ARTICLE XII. - ABANDONED AND DISTRESSED PROPERTIES
Sec. 18-703. - Registration requirements.
(a)
Any beneficiary and trustee under a deed of trust, or their designee, on abandoned property located within the city shall perform an inspection of the property that is the security for the deed of trust, upon default by the trustor, prior to recording a notice of default with the Los Angeles County Registrar-Recorder's office. If the property is found to be vacant or shows evidence of vacancy, the beneficiary and trustee shall, within ten calendar days following the inspection, register the property with the code enforcement manager on forms provided by the city. The beneficiary and trustee shall post a notice no less than 8.5" x 11" ion size on the property indicating the most recent date and time of inspection. The notice shall be posted in a manner consistent with subsection 18-705(c). A failure to perform such inspection or post a notice of inspection shall constitute a violation of this article.
(e)
An annual registration fee for the beneficiary and trustee shall accompany the registration form. Registration fees will not be prorated. The fee and registration shall be valid for the calendar year, or remaining portion of the calendar year, in which the registration was initially required. Subsequent registrations and fees are due January 1st of each year and must be received by the code compliance manager no later than January 31st of the year due. The amount of the registration fee shall be set by resolution of the city council.
Annual Registration Fee
The Vacant Property Program collects fees to help cover the cost of the program administration and operational costs. The Vacant Property fee increases each year according to the Consumer Price Index (CPI).
