CITY OF ARCHER, FLORIDA
ORDINANCE NUMBER 01-2025
AN ORDINANCE, CREATING CHAPTER 8, ARTICLE V, OF THE CODE OF ORDINANCES, CITY OF ARCHER, FLORIDA, TO BE ENTITLED, "REGISTRATION OF FORECLOSING MORTGAGES AND VACANT PROPERTY"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES AND VACANT PROPERTY BY OWNERS; PROVIDING FOR PENALITIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE CITY OF ARCHER; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
Sec. 8-94. INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the City of Archer Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action. A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $350.00 for each property. Subsequent non-refundable Semi-Annual renewal registration of properties and fees in the amount of $350.00 are due within ten (10) days of the expiration of the previous registration. Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted properties, (3) post-closing counseling and Foreclosure intervention limited to Owner-occupied persons in Default, which may not include cash and mortgage modification assistance, and (4) for any related purposes as may be adopted in the policy set forth in this Chapter. Said fees shall be deposited to a special account in the City of Archer's Department dedicated to the cost of implementation and enforcement of this Ordinance, and fulfilling the purpose and intent of this Chapter. None of the funds provided for in this section shall be utilized for the legal defense of Foreclosure Actions.

AN ORDINANCE REQUIRING THE REGISTRATION OF PROPERTIES THAT ARE VACANT OR FORECLOSING
DIVISION 15. - VACANT AND FORECLOSED PROPERTIES
Sec. 4-1-15-3. Registration of foreclosed property.
(b) Within ten (10) days after the date any mortgagee or affiliate entity of a mortgagee takes title to a foreclosed property, the mortgagee shall register the real property with the registry established by Section 4-1-15-3. A separate registration is required for each foreclosed property. Mortgagees of a foreclosed property that took title to such property prior to the passage of this ordinance shall register such properties in accordance with this Section within thirty (30) calendar days after the effective date of said ordinance. If the real property is vacant at the time of registration, the mortgagee shall designate in writing a property manager to inspect, maintain, and secure the real property subject to the mortgage.
Sec. 4-1-15-5. Registration of vacant property.
(b) Any owner of vacant property located within the City shall, within ten (10) days after the property becomes a vacant property, register the real property with the registry established by Section 4-1-15-3. A separate registration is required for each vacant property. Owners of property that is vacant at the time of the adoption of this ordinance creating this Division must register the property in accordance with this section within thirty (30) days after the effective date of said ordinance.
Sec. 4-1-15-6. Renewal of registration; registration fees.
(a) The registration required by this Division shall expire and must be renewed by the owner or mortgagee, as applicable, six (6) months after the date of the first event or action that makes the property a registrable property, as defined by this Division, which may be different from the date of initial registration, and every six (6) months thereafter so long as the property remains a registrable property. No property shall be deemed to have met the registration requirements of this Division unless all fees established by this section have been paid.
(b) A non-refundable of $300.00 shall be paid by the owner of a vacant property or mortgagee of a foreclosed property at the time of initial registration of any registrable property pursuant to the requirements of this Division. A non-refundable renewal fee in the amount of $300.00 shall be paid no later than ten (10) days prior to the expiration of the previous semi-annual registration period.

The city of Yonkers, N.Y. has amended its property registration ordinance to reflect an annual registration requirement with an escalating fee schedule of $1,000.00 for initial registration and $2,000.00 for each subsequent renewal. The program will continue to require annual registration within 30 days of vacancy.

Article VIII Vacant Building Registry
Sec. 58-34 Vacant building registration; fees.
A. The owner shall register with the Department of Housing and Buildings no later than 30 days after any building located in the City becomes a vacant building or not later than 30 days after being notified by the Department to register. The Enforcement Officer may identify vacant buildings through its routine inspection process as well as through notification by residents, neighborhood associations and other community groups that a building may be eligible for inclusion on the registry. The owner shall register the property annually with the Department of Housing and Buildings. The renewal date shall be January 31 of each year.
G. Vacant building fees.
(1) The owner of a vacant building shall pay an annual fee as set forth in Subsection G(3) for the period the building remains a vacant building. The fee shall be paid within 30 days after the building becomes vacant. Ff the fee is not paid within such time, the owner shall be subject to penalties and any additional fees that may be imposed at a trial or an administrative hearing. The fee shall be reasonably related to the administrative costs for registering and processing the vacant building owner registration form and for the costs of the City in monitoring the vacant building site.
(2) The first annual fee shall be paid no later than 30 days after the building becomes vacant.
(3) The following fees are hereby imposed:
