AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AMENDING CHAPTER 14, OF THE CITY OF OPA-LOCKA'S CODE OF ORDINANCES, ENTITLED "NUISANCES" CREATING NEW SECTION 14-13(1) AND SUBSEQUENT NUMERICAL SECTIONS TO BE ENTITLED, "REGISTRATION OF ABANDONED, VACANT, FORECLOSURE PROPERTIES"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY; PROVIDING FOR REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY; PROVIDING FOR PENALITIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION, AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE CITY OF OPA LOCKA; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
Sec. 14-13 (5) INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the City of Opa-Locka Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action. A separate registration is required for each property under a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of Three Hundred Dollars ($300.00) for each property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fee in the amount of Three Hundred Dollars ($300.00) are due within ten (10) days of the expiration of the previous registration.
Sec. 14-13 (6) INSPECTION AND REGISTRATION OF REAL PROPERTY THAT IS NOT SUBJECT TO A MORTGAGE IN FORECLOSURE
(a) Any Owner of Vacant property, as defined in this chapter, located within the City of Opa Locka shall within ten (10) days after the property becomes Vacant, register the Real Property with the City of Opa Locka Registry. Structures that are vacant property at the time of the adoption of this ordinance must register within fifteen (15) days of the date this ordinance takes effect.
(c) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $300.00 for each Vacant property. Subsequent non-refundable Semi-Annual renewal registrations of Vacant properties and fees in the amount of $300.00 are due within ten (10) days of the expiration of the previous registration.

C. Registration of Abandoned/Vacant Properties.
The lenders or other responsible parties of real property which has been abandoned shall register that property with the City of Liberty Lake Planning & Building Services within thirty (30) days of the property becoming abandoned or of receiving notice from the City of the requirements of this chapter.

Rockdale County, Ga. has amended its property registration requirement to reflect an initial registration fee of $80.00. The ordinance will continue to require registration within 60 days of vacancy. Registration will require annual renewal accompanied by a fee of $100.00.

Vacant Property Registration & Renewal Form
It is the duty of each owner of any vacant building or dwelling subject to Ordinance 2018-14 (codified as 42-101), to file a registration statement with the Department of Planning and Development within 60 days of the of the building or dwelling becoming vacant, or within 90 days after acquiring ownership, whichever is later, of any vacant residential building or dwelling not currently registered. If the Code Enforcement Division provides written notice to the owner of the existence of any vacant building or dwelling, the owner of such vacant building or dwelling shall register within 30 days of such notice.
The registration shall remain valid for twelve (12) months from the date of registration. If ownership of a registered structure changes during this period, the new owner shall file an amended registration statement within 20 days of accepting the vesting instrument. The owner shall be required to renew the registration annually if the building or dwelling remains vacant for any part thereof.
AN ORDINANCE TO AMEND SUBPART A - GENERAL ORDINANCES OF THE CODE OF ROCKDALE COUNTY, GEORGIA, AS AMENDED, TO AMEND CHAPTER 42 ENVIRONMENT, DIVISION 2 REGULATIONS OF VACANT REAL PROPERTY, SECTION 42-14 - REGISTRATION/RENEWAL FEES; TO PROVIDE FOR REAL OF CONFLICTING PROVISIONS; TO PROVIDE FOR AN ADOPTION DATE; AND FOR OTHER PURPOSES.

Replace with the following language: At the time of filing of the registration statement, the owner shall pay a registration fee in the amount of $80.00 for each vacant real property. No registration statement shall be deemed filed unless the fee has been paid. For a parcel of land containing two or more buildings under common ownership, only one registration statement and one fee shall be required. At the time of expiration of the original filing, the owner shall be responsible for renewing the registration statement if the property is still vacant. The owner shall pay a registration fee in the amount of $100.00 for each vacant real property. No registration statement shall be deemed filed unless the fee has been paid. For a parcel of land containing two or more buildings under common ownership, only one registration statement and one fee shall be required. The property is inspected to determine its maintenance, and any fees to maintain the property shall be assessed, and due at the time of renewal.
The city of Troy, N.Y. has amended its property registration requirement to reflect the following escalating fee schedule:
Initial Registration: $750.00
1st Renewal: $1,500.00
2nd Renewal: $2,500.00
3rd Renewal: $4,000.00
4th Renewal: $5,000.00
5th and Subsequent Renewals: $6,000.00
The program will continue to require registration within 30 days of vacancy.

C. Not later than 30 days after any building located within an area zoned for or located immediately adjacent to an area zoned for any residential use in the City becomes vacant the owner shall register the building with the Bureau of Code Enforcement, shall board and secure the building pursuant to Sec. 141-21C(1) below, shall file a plan detailing how the owner will maintain the building pursuant to Sec. 141-21C(2) and how the owner will proceed in an expeditious manner to remove the building from its vacant status pursuant to Sec. 141-21C(3) below, and shall pay the annual vacant building registration fee.

The owner of a vacant building shall file a plan explaining how he/she will comply with Sec. 141-21 Vacant Building Plan and Fees of the City Code and shall pay an initial registration fee of $750. If the building remains vacant, each January 1st following the initial registration the owner shall pay an annual fee as follows:

The city of Nokomis, Ill. has enacted a property registration requirement within 10 days of foreclosure or within 10 days of vacancy. The program will require semi-annual registration accompanied by a fee of $325.00.

a. A registration is valid for one calendar year following the date on which registration is initially submitted to the City. Subsequent registrations are required and due each year thereafter on the anniversary of the submittal date of the initial registration until such time as the property is transferred or becomes legally occupied.
