ARTICLE V. - REGISTRATION AND MAINTENANCE OF MORTGAGED REAL PROPERTY IN DEFAULT
Sec. 13-109. - Registration of real property mortgagee holding mortgages in default.
(a) Any mortgagee who holds a mortgage on real property located within the City of Titusville shall within ten (10) days of the date the mortgagee declares its mortgage to be in default, register the real property with the city or city's designee and, at the time of registration, shall designate in writing a local property manager to inspect, maintain and secure the real property subject to the mortgage in default.
(d) Properties subject to this section shall remain under the bi-annual registration requirement, inspection, security and maintenance standards of this section as long as they remain in default.
Sec. 13-110. - Registration fees.
The city council shall establish by resolution fees for the registration and re-registration requirements of this article. Said fees shall be based on the reasonable estimated cost of administering the provisions of this article and shall be due and payable at the time of registration or re-registration. The city may delegate the collection of such fees to an independent contractor.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TITUSVILLE FLORIDA:
Section 1. That Resolution No. 30-2023 is hereby amended, as follows: establishing a registration fee which allocated a portion of the fees for services of a contractor which are now being performed by staff, and Council wishes to amend the registration fee accordingly. The registration fees to register or re-register any vacant real property with the City pursuant to Sections 13-109 and 13-110 of the Code of Ordinances shall be $300.00 per property registration and shall be collected by the City of Titusville.

SEC. 366-5 INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
B. Within ten (10) days of the date any Mortgagee files a Foreclosure Action, lis pendens, notice of lis pendens, notice of sale or any other pleading or document evidencing that Default has occurred, the Mortgagee shall enter the Registrable Property on the Registry and, at the time of registration indicate whether the Registrable Property is Vacant, and if so, shall designate in writing a Property Manager to inspect, maintain, and secure the Registrable Property. A separate registration is required for each Registrable Property subject to this Ordinance, regardless of whether it is occupied or Vacant.
E. At the time of the initial Registration, a nonrefundable Semi-Annual Registration Fee shall be paid for each piece of Real Property entered into the Registry. Registration pursuant to this Chapter is subject to a Semi-Annual Renewal Registration for each Real Property and is due within ten (10) days of the expiration of the previous Registration.

The city of Olean, N.Y. has enacted a property registration requirement within 30 days of vacancy. The program will not require a fee if the property is registered within 30 days of vacancy. If the owner fails to timely register the building, the fee will be $50.00. If the building remains vacant for one year or more, annual renewals will begin at $500.00 and increase by $100.00 for each year the building remains vacant, not to exceed a total fee of $1000.00.

City of Olean
VACANT BUILDING REGISTRATION FORM
Pursuant to Sec. 6-30(c) of the Code of Ordinances of the City of Olean, the owner of a building shall within thirty (30) days in which that building has been defined as a "vacant building" by Sec. 6-30(b) of said Code of Ordinances, complete this form and register the said "vacant building" with the Code Enforcement Office for the City of Olean, New York.
The owner shall pay no registration fee if the building is registered within 30 days after the building becomes a "vacant building". If the owner fails to timely register the building then the owner shall pay a registration fee of fifty dollars ($50.00) for each building registered. In addition to any registration fee, if the building remains continuously vacant for one year or more from the date of registry, the owner shall pay an annual vacant building fee, on each annual anniversary date until the building is demolished or rehabilitated and returned to use. The said annual fee for the first year shall be $500.00 and for each year thereafter, the fee shall be the annual fee for the immediately preceding year plus $100.00, but in no event shall the annual fee exceed one thousand dollars ($1,000.00).
The city of Irving, Texas has enacted a property registration requirement within 90 days of vacancy. The program will require annual registration accompanied by a fee of $325.00.

ARTICLE X
VACANT BUILDING REGISTRATION
Sec. 8-69. Certificate of registration.
(a) Registration required. Any person who owns a vacant building shall obtain and maintain a current and valid certificate of registration. A certificate of registration is required if any building on the premises is a vacant building. Affirmative defenses to this subsection include:
(1) The building has been occupied in the preceding 90 days
(e) Expiration and renewal.
(1) A certificate of registration expires:
a, One year after the date of issuance
(2) An owner shall renew a certificate of registration by making application in accordance with this section 8-69 and paying all fees described in section 8-70. A registrant shall apply for renewal of the certificate of registration at least 30 days but no more than 60 days prior to its expiration.
Sec. 8-70. Registration fee.
(a) Applicants for issuance or renewal of a certificate of registration shall pay a fee as established in the city's consolidated fee schedule.

1370.04 OWNER REQUIRED TO ACT; ENFORCEMENT AUTHORITY.
(a) The Owner of any structure that has become vacant as defined above shall within thirty (30) days after the structure first becomes vacant, or within thirty (30) days of receiving notice that a structure is vacant, or within thirty (30) days after the effective date of this Chapter, whichever is later, file a registration statement for each such structure with the Code Administrator or his or her designee on forms provided for such purposes.
(1) The registration shall remain valid for one year from the date of registration. The registering party shall be required to annually renew the registration as long as the structure remains vacant and shall pay an annual registration fee of one hundred dollars ($100.00) for each residential structure and two hundred and fifty dollars ($250.00) for each commercial or industrial structure; provided, however, that all religious, educational, benevolent or charitable associations, and all governmental agencies shall be exempt from the payment of the annual registration fee. The registering party shall not be entitled to a refund of all or any part of the registration fee should the structure no longer be deemed vacant during the annual registration period.
The village of Park Forest, Ill. has amended its property registration ordinance to require registration within 10 days of foreclosure filing. The program will require semi-annual registration accompanied by a $375.00 fee.

AN ORDINANCE, AMENDING CHAPTER 18, ARTICLE VI, VACANT BUILDINGS, OF THE CODE OF ORDINANCES, VILLAGE OF PARK FOREST, COOK AND WILL COUNTIES, ILLINOIS, BY AMENDING SEC. 18-502, DEFINITIONS, AND CREATING A NEW SECTION 525 "INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE"; PROVIDING FOR PURPOSE, INTENT AND APPLICABILITY OF THE ORDINANCE REQUIRING THE REGISTRATION AND MAINTENANCE OF CERTAIN REAL PROPERTY BY MORTGAGEES; PROVIDING FOR PENALTIES AND ENFORCEMENT, AS WELL AS THE REGULATION, LIMITATION AND REDUCTION OF REGISTRABLE REAL PROPERTY WITHIN THE VILLAGE; PROVIDING FOR SEVERABILITY, REPEALER, CODIFICATION, AND AN EFFECTIVE DATE.
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Registrable Property with the Village Registry, and, at the time of registration, indicate whether the Registrable Property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Registrable Property subject to the mortgage under a Foreclosure Action. A separate registration is required for each Real Property subject to a Foreclosure Action, regardless of whether it is occupied or vacant.
(e) At the time of initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of $375.00 for each Registrable Property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of $375.00 are due within ten (10) days of the expiration of the previous registration. Said fees shall be used to offset the costs of: (1) registration and registration enforcement, (2) code enforcement and mitigation related to Defaulted Real Properties, (3) post-closing counseling and Foreclosure intervention limited to Owner-occupied persons in Default, which may not include cash and mortgage modification assistance and (4) for any related purposes as may be adopted in the policy set forth in this Chapter. Said fees shall be utilized for the Village's Community Development Department, dedicated to the cost of implementation and enforcement of this Ordinance and fulfilling the purpose and intent of this Chapter. None of the funds provided for in this Section shall be utilized for the legal defense of Foreclosure Actions.
The city of Maumee, Ohio has enacted a property registration requirement within 30 days of vacancy or foreclosure filing. The program will require a $10,000 cash bond for each registered property, as well annual registration accompanied by a $125.00 fee.

1380.04 REGISTRATION OF VACANT PROPERTIES, PROPERTIES IN DEFAULT AND REO PROPERTIES.
(b) Registration. The responsible party for any vacant property shall register with the Maumee Service Department within thirty (30) days of vacancy.
The responsible party for a property owner, property in default, including, but not limited to, a lender or servicing company, shall register the property with the Zoning/Compliance Department within thirty (30) days of the recording of the notice of default or, if the notice of default was issued prior to the effective date of this chapter, within sixty (60) days of the effective date of this chapter.
The responsible party for a REO property, including, but not limited to, a lender or servicing company, shall register the property with the Maumee Service Department within thirty (30) days of the transfer of title or, if the title was transferred prior to the effective date of this chapter, within sixty (60) days of the effective date of this chapter.
(c) Maintenance Bond. (See Appendix 2) Any owner of a vacant and/or foreclosing property may be required to provide a cash bond acceptable to the City Administrator (or designee), in the sum of not less than ten thousand dollars ($10,000.00), to secure the continued maintenance of the property throughout its vacancy and remunerate the city for any expenses incurred in inspecting, securing, marking, or making such building safe. A portion of said bond shall be retained by the city as an administrative fee to fund an account for expenses incurred in inspecting, securing, and marking said building and other such buildings that are not in compliance with this section. Any owner of a vacant or foreclosing property providing a bond pursuant to this section must also provide bonds for all other vacant or foreclosing properties owned in the city.
(f) Fees. The responsible party shall pay a non-refundable fee of one hundred twenty-five dollars ($125.00) for each registered property to cover the costs of the registry including, but not limited to, initial creation of the registry; ongoing maintenance of the registry; inspection and investigation of registered properties to ensure that the information recorded in the registry is current and accurate; inspection and investigation of registered properties conducted by the Service Department or Urban Planning Manger to ensure that they have not fallen into disrepair or are otherwise not in compliance with the requirements of Section 1380.05 and/or any other applicable requirements; and the administrative costs incurred in determining the appropriate fee. These costs shall be determined annually by the City.
