CHAPTER 18.24 - FORECLOSURE REGISTRY PROGRAM
18.24.030 - Registration.
A. Not later than ten (10) days after recording a notice of default on any residential property located in the City of Long Beach which is subject to a deed of trust, the beneficiary, or its trustee, shall register the property with the Development Services Department of the City of Long Beach on forms provided by the city.
B. The registration pursuant to this Section shall be renewed annually until such time as:
1. The foreclosure process is complete or the notice of default has been rescinded or withdrawn;
2. The Trustor has surrendered the property to the beneficiary as evidenced by either a letter from the trustor addressed to the beneficiary confirming such surrender, or by the trustor's delivery of the keys to the property to the beneficiary or its agent.
3. The beneficiary has obtained possession of the property under Section 1161 or 1161a or 1161b of the Code of Civil Procedure, as applicable, following completion of the foreclosure proceedings.
D. An annual registration fee as set by the City Council by resolution shall accompany the submission of each registration form. The fee and registration shall be valid for one (1) year from the date of the registration. Registration fees will not be prorated. Subsequent registrations and fees are due January 1st of each year and must be received no later than January 15th of the year due.

An initial registration fee shall accompany this registration form. The registration shall be valid for one year from the date of registration. Subsequent registrations and fees will be due January 1st of each year and must be received no later than January 15th of the year due. Any changes to the information required must be reported to the Long Beach Community Development Department within 10 days of the change. This form may be utilized to report updated information by checking the "Updated Registration" box and submitting it to LBCD at the address indicated above. ARTICLE XVIII
PROPERTY MAINTENANCE
Registration and Maintenance of Abandoned and/or Foreclosed Properties.
Section 3: Registration required
A. All owners or mortgagees of abandoned and/or foreclosed residential properties shall register such properties with the Commissioner on forms provided by the Commissioner. If the owner is an out-of-state corporation, person, or other entity, the owner shall appoint an in-state agent authorized to accept service of process and other documents under this bylaw.
1. Each registration must state the owner's, mortgagee's or agent's name, telephone number and mailing address located within the Commonwealth of Massachusetts, including the name of the owner, street number, street name, city or town, and zip code; the mailing address shall not be a post office box.
2. Each registration must also certify that the property has been inspected by the owner and must identify whether the property is abandoned, and if abandoned, the condition of the property and the status of maintenance thereof. Each registration must designate a local individual or local property management company responsible for the maintenance and security of this property. This designation must state the individual or company's name, direct telephone number, and local mailing address; the mailing address shall not be a post office box.
i. If the owner's inspection determines that the property is abandoned, the registration must be received by the Commissioner within seven days of the owner's inspection.
ii. If the owner's inspection determines that the property is not abandoned, but has been foreclosed, the registration must be received by the Commissioner within seven days of the foreclosure.
B. All property registrations pursuant to this section are valid for one calendar year from the date when the registration is received by the Commissioner. An annual registration fee of $100 must accompany the registration form. Subsequent registrations and fees are due within 30 days after the date of the expiration of the previous registration. Subsequent registrations must certify whether the property remains abandoned and/or remains in foreclosure and shall restate the current condition of such property as required above.

The township of East Greenwich, N.J. has amended its property registration ordinance to reflect an annual fee of $500.00 for occupied properties in foreclosure and an additional $2,000.00 fee if the property is in foreclosure and determined to be vacant. The program will continue to require annual registration within 10 days of foreclosure filing.

Chapter 15.44 - VACANT, ABANDONED, AND FORECLOSED PROPERTIES
15.44.045 - Registration of vacant, abandoned, and foreclosed real property.
A. Any mortgagee that holds a mortgage on real property located within the Municipality of East Greenwich Township shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor and the recordation of a lis pendens. The mortgagee shall within ten (10) days of the inspection, register the property with the code enforcement department, or designee, on forms or website access provided by the municipality, and indicate whether the property is vacant or occupied. A separate registration is required for each property, whether it is found to be vacant or occupied.
B. If the property is occupied but remains in default, it shall be inspected by the mortgagee or his designee monthly until (1) the mortgagor or other party remedies the default, or (2) it is found to be vacant or shows evidence of vacancy at which time it is deemed abandoned, and the mortgagee shall, within ten (10) days of that inspection, update the registration to a vacancy status on forms provided by the municipality.
D. A non-refundable annual registration fee in the amount of five hundred dollars ($500.00) per property shall accompany the registration form or website registration.
An annual fee shall also be imposed on a creditor required to register a property pursuant to this section, which shall be due by January 1 of each year. Any form submitted on or after March 1 shall be subject to a late fee of fifty dollars ($50.00) per month for a maximum amount of five hundred dollars ($500.00). The fee shall not exceed:
1. Five hundred dollars ($500.00) per property annually for any property that is required to be registered because a summons and complaint in an action to foreclosure was filed by the creditor; and
2. If a property registered with the township's registration program as a property in foreclosure and is determined to be vacant and abandoned at the time of registration, or becomes vacant and abandoned at any time during the pendency of the foreclosure proceeding, the creditor shall pay an additional annual registration fee of two thousand dollars ($2,000.00) per property, due at the time the determination that the property is vacant and abandoned is made.
The borough of Swissvale, Pa. has amended its property registration ordinance to reflect an updated annual fee of $400.00. The program will continue to require annual registration within 20 days of default or vacancy.

SEC. 10-604. REGISTRATION OF VACANT REAL PROPERTY
(a) Any owner or mortgagee who owns or holds a mortgage on real property located within the Borough of Swissvale shall perform an inspection of the property to determine vacancy or occupancy within 10 days of default by the mortgagor or upon the property becoming abandoned or vacant real property as defined in this Part. The owner or mortgagee shall, within 20 days of default or of the property becoming abandoned or vacant, register the property on forms provided by the Borough of Swissvale. For properties that are currently in default, abandoned or vacant as of the enactment of this Part, inspection and registration shall occur within 20 days of the enactment of this Part. A separate registration is required for each property, whether it is found to be vacant or occupied. The owner and mortgagee of a property shall be jointly and severally liable for failing to fulfill inspection and registration requirements described in this part.
