AN ORDINANCE REPEALING AND REPLACING TITLE 4 (BUILDING REGULATIONS), CHAPTER 15 (VACANT BUILDINGS AND VACANT LOTS) OF THE MINOOKA VILLAGE CODE OF ORDINANCES
CHAPTER 15. REGISTRATION OF FORECLOSING MORTGAGED PROPERTY AND VACANT PROPERTY
Sec. 4-154-5. INSPECTION AND REGISTRATION OF REAL PROPERTY UNDER FORECLOSURE
(c) Within ten (10) days of the date any Mortgagee files a Foreclosure Action, the Mortgagee shall register the Real Property with the Village Registry, and, at the time of registration, indicate whether the property is Vacant, and if so shall designate in writing a Property Manager to inspect, maintain, and secure the Real Property subject to the mortgage under a Foreclosure Action when legally possible.
(e) At the time of the initial registration each registrant shall pay a non-refundable Semi-Annual Registration fee of one hundred and seventy-five dollars ($175.00) for each property. Subsequent non-refundable Semi-Annual renewal registrations of properties and fees in the amount of one hundred and seventy-five dollars ($175.00) are due within ten (10) days of the expiration of the previous registration.

LOCAL LAW 4-2022
Sec. 157-86 Registration of defaulted mortgage real property.
A. Any mortgagee who holds a mortgage on real property located within the Town shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor as evidenced by a foreclosure filing. The mortgagee shall, within 10 days of the inspection, register the property with the Town, or its designee, on forms or other manner as directed, and indicate whether the property is vacant or occupied.
C, Each individual property on the registry that has been registered for 12 months or more prior to the effective date shall have 30 days to renew the registration and pay the non-refundable semiannual registration fee. Properties registered less than 12 months prior to the effective date shall renew the registration every six months from the expiration of the original registration renewal date and shall pay the nonrefundable semiannual registration fee.
Amending 2022 Fee Schedule
WHEREAS, by Resolution No. 486-2021, adopted December 14, 2021, the Town Board adopted the fee schedule for 2022 for various departments and boards within the Town of Clarkstown, and
WHEREAS, on March 22, 2022, the Town Board adopted Local Law No. 4-2022, creating a new article of chapter 157 of the Town Code, which Article XI is entitled "Registration of Defaulted and Vacant Properties, " and
WHEREAS, under said law, any mortgagee who holds a mortgage on real property located within the Town shall perform an inspection of the property to determine vacancy or occupancy, upon default by the mortgagor as evidenced by a foreclosure filing, and
WHEREAS, under said law, the mortgagee shall, within 10 days of the inspection, register the property with the Town, or its designee, and pay a semiannual registration fee, and
WHEREAS, such fee was not included in the 2022 Fee Schedule as adopted;
NOW, THEREFORE, be it
RESOLVED, that the Town Board hereby amends the 2022 Town Fee Schedule, as adopted by Resolution No. 486-2021, by adding to the Town's fee schedule a Registration of Defaulted Mortgage Real Property Fee, and be it
FURTHER RESOLVED, that said fee is $500 per property semiannual, and be it
FURTHER RESOLVED, that this resolution be retroactive to March 22, 2022.

a) Any Mortgagee who holds a mortgage on any property which is or becomes a Registrable Property shall perform an inspection of the property to determine vacancy or occupancy. With respect to any Registrable Property, the Mortgagee shall, within ten (10) days of the inspection, register the property with the Township, or its agent, on forms or other manner as directed, and indicate whether the property is Vacant or occupied.
g) A non-refundable six-month Registration fee established by resolution by the Board, shall accompany each Registration pursuant to this section.
